THURSDAY INSIGHT FEATURES
A LETTER TO THE EDITOR YOU MUST READ

Remember the guy who got on a plane with a bomb built
into his shoe and tried to light it? Did you know his
trial is over? Did you know he was sentenced? Did you
see/hear any of the judge's comments on TV or Radio?
Didn't think so!!!
Everyone should hear what the judge had to say. Ruling
by Judge William Young, US District Court. Prior to
sentencing, the Judge asked the defendant if he had
anything to say His response: After admitting his guilt
to the court for the record, Reid also admitted his
'allegiance to Osama bin Laden, to Islam, and to the
religion of Allah,' defiantly stating, 'I think I will
not apologize for my actions,' and told the court 'I am
at war with your country.' Judge Young then delivered
the statement quoted below:
Judge Young: 'Mr. Richard C. Reid, hearken now to the
sentence the Court imposes upon you. On counts 1, 5 and
6 the Court sentences you to life in prison in the
custody of the United States Attorney General. On counts
2, 3, 4 and 7, the Court sentences you to 20 years in
prison on each count, the sentence on each count to run
consecutively. (That's 80 years.)
On count 8 the Court sentences you to the mandatory 30
years again, to be served consecutively to the 80 years
just imposed. The Court imposes upon you for each of the
eight counts a fine of $250,000 that's an aggregate fine
of $2 million. The Court accepts the government's
recommendation with respect to restitution and orders
restitution in the amount of $298.17 to Andre Bousquet
and $5,784 to American Airlines.The Court imposes upon you an $800 special
assessment. The Court imposes upon you five years
supervised release simply because the law requires it.
But the life sentences are real life sentences so I need
go no further.
What your able counsel and what the equally able United
States attorneys have grappled with and what I have as
honestly as I know how tried to grapple with, is why you
did something so horrific. What was it that led you here
to this courtroom today? This is the sentence that is
provided for by our statutes. It is a fair and just
sentence. It is a righteous sentence.
Now, let me explain this to you. We are not afraid of
you or any of your terrorist co-conspirators, Mr. Reid.
We are Americans. We have been through the fire before.
There is too much war talk here and I say that to
everyone with the utmost respect. Here in this court, we
deal with individuals as individuals and care for
individuals as
individuals. As human beings, we reach out for justice.
You are not an enemy combatant. You are a terrorist. You
are not a soldier in any war. You are a terrorist. To
give you that reference, to call you a soldier, gives
you far too much stature. Whether the officers of
government do it or your attorney does it, or if you
think you are a soldier, you are not-----, you are a
terrorist. And we do not negotiate with terrorists. We
do not meet with terrorists. We do not sign documents
with terrorists. We hunt them down one by one and bring
them to justice.
So war talk is way out of line in this court You are a
big fellow. But you are not that big. You're no warrior.
I've known warriors. You are a terrorist. A species of
criminal that is guilty of multiple attempted murders.
In a very real sense, State Trooper Santiago had it
right when you first were taken off that plane and into
custody and you wondered where the press and the TV
crews were, and he said: 'You're no big deal.' 'You are
no big deal.' I have listened respectfully to what you
have to say. And I ask you to search your heart and ask
yourself what sort of unfathomable hate led you to do
what you are guilty and admit you are guilty of doing?
And, I have an answer for you. It may not satisfy you,
but as I search this entire record, it comes as close to
understanding as I know.
It seems to me you hate the one thing that to us is most
precious. You hate our freedom. Our individual freedom.
Our individual freedom to live as we choose, to come and
go as we choose, to believe or not believe as we
individually choose. Here, in this society, the very
wind carries freedom. It carries it everywhere from sea
to shining sea. It is because we prize individual
freedom so much that you are here in this beautiful
courtroom, so that everyone can see, truly see, that
justice is administered fairly, individually, and
discretely. It is for freedom's sake that your lawyers
are striving so vigorously on your behalf, have filed
appeals, will go on in their representation of you
before other judges.
We Americans are all about freedom. Because we all know
that the way we treat you, Mr. Reid, is the measure of
our own liberties. Make no mistake though. It is yet
true that we will bear any burden; pay any price, to
preserve our freedoms. Look around this courtroom. Mark
it well. The world is not going to long remember what
you or I say here. The day after tomorrow, it will be
forgotten, but this, however, will long endure.
Here in this courtroom and courtrooms all across
America, the American people will gather to see that
justice, individual justice, justice, not war,
individual justice is in fact being done. The very
President of the United States through his officers will
have to come into courtrooms and lay out evidence on
which specific matters can be judged and juries of
citizens will gather to sit and judge that evidence
democratically, to mold and shape and refine our sense
of justice.
See that flag, Mr. Reid? That's the flag of the United
States of America. That flag will fly there long after
this is all forgotten. That flag stands for freedom. And
it always will.Mr.
Custody Officer. Stand him down.
So, how much of this Judge's comments did we hear on our
TV sets? We need more judges like Judge Young. Pass this
around. Everyone should and needs to hear what this fine
judge had to say. Powerful words that strike home.

criminals criminals? Can't call a person in our country
illegally an illegal alien. You can't call a liar a
liar, thus no Democrat elected person can be judged on

Jokesman...oh he considers himself a spokesperson, a

Ronny, who opened the door for Clinton. But today, we
are hated, and disrespected.

THE PORNO PATROLMAN
A 28 year old California Highway Patrolman was riding his
motorcycle on Santa Monica Blvd. As he approached the railroad
tracks his front wheel dropped into a hole adjacent to the tracks
and this caused him to be flipped from the motorcycle in a
somersault fashion landing on his head on the pavement.
He retained an attorney and filed a lawsuit. Shortly after the
accident he was forced to leave the employ of the California Highway
Patrol as he had been caught in a scam that involved removing a
person's credit card from their wallet when he checked their
driver's license, and then using the card for his own gain. However
he went on to bigger and better things, next becoming involved as
the owner of two massage parlors in Inglewood that fronted for
prostitution. Shortly before his case was called for a mandatory
settlement conference he was arrested at the massage parlor had his
picture and story were in the Los Angeles Times newspaper.
We were ordered for the mandatory settlement conference at the
Santa Monica Superior Court in front of Judge Mario Clinko, who had
a reputation all over California of getting difficult cases settled. When we appeared at the conference the plaintiff attorney told the
judge that he was only making a claim for one year wage loss and no
more, even thought it was three years after the accident. The judge
asked him why and he said that the massage parlors all over Southern
California started in Business about one year after his client's
accident. The judge then asked him how he knew this and he said that
he represented many of the massage parlor operators.
The judge asked why what a nice Jewish boy like him was doing in
this business and he said his wife often asked him the same
question. We then told the judge about the well-publicized arrest
and some of the other seedier facts about the plaintiff and the
judge forced a settlement from the plaintiff at a nuisance value.
The plaintiff then went on to become known as the Porno King of
Orange County. In addition to massage parlors, he owned numerous
adult bookstores. Several years later, I again read in the Los
Angeles Times that he had been gunned down in his driveway at his
home in Orange County by an unknown assassin. The newspaper article
refereed to him as the Porno King of Orange County.

A Hispanic engineering department employee was working with a rail grinder on the main line. The rail-grinder does make some noise when it is in operation and he did not hear the approach of a train. Also the look out, which was another employee who was supposed to be watching for trains, was engaged elsewhere and did not warn him of the trains' approach. At the last minute he saw the train coming and dropped to the ties flat on his back in between the rails.
All of the locomotives and the cars passed over him and other employees at the scene thought he was dead. The good news is he did not even sustain a scratch and walked away form the scene, but not before he was given the nickname of Muerto, which means death in Spanish. This name remained with him during his entire railroad carrier and he became another of the legends on the railroad
(as

insulated from reality that they imagine that America
can suffer defeat without any inconvenience to

1. In 1968, Bobby Kennedy was shot and killed by a
Muslim male.
2. In 1972 at the Munich Olympics, Israeli athletes were
kidnapped and massacred by Muslim males.
3. In 1972 a Pan Am 747 was hijacked and eventually
diverted to Cairo where a fuse was lit on final approach
and it was blown up shortly after landing by Muslim
males.
4. In 1973 a Pan Am 707 was destroyed in Rome with 33
people killed when it was attacked with grenades by
Muslim males.
5. In 1979, the US embassy in Iran was taken over by
Muslim males.
6. During the 1980's a number of Americans were
kidnapped in Lebanon by Muslim males.
7. In 1983, the U.S. Marine barracks in Beirut was blown
up by Muslim males.
8. In 1985, the cruise ship Achille Lauro was hijacked
and a 70 year old American passenger was murdered and
thrown overboard in his wheelchair by Muslim males.
9. In 1985, TWA flight 847 was hijacked in Athens and a
US Navy diver trying to rescue passengers was murdered

killing us, airport security screeners will no longer be

They must conduct random searches of 80-year old women,
little kids, airline pilots with proper identification,
Secret Service agents who are members of the President's
security detail, 85-year old Congressmen with metal hips
and Medal of Honor winner and former Governor Joe Foss,
but leave Muslim Males alone lest they be guilty of
profiling.
Have the American people
completely lost their Minds or just their Power of
Reason???

Dentists to our Chiropractors, for our Janitors to our
Teachers, and so forth, we must make our government
accountable rather then above the law itself.
Our Poor are poorer today then since the great
Depression. The divide between the classes has
almost eliminated our middle class.
Our retired seniors living on a 'fixed income'
receive no extra aid nor do they get any special
breaks--nadda beyond shopping discounts...
AND Congress wants to freeze Social Security payments
when in November of this Year our seniors will get the
bad news on the true loss of many of their Medicare
benefits.
You do know that Congress got themselves a pay raise
for 2013!!! Google this--it's true!!!

It Make" follows:
Did you know that InfoJustice Men
of the month last September, Tyrone Woods and
Glen Doherty killed 60 of the attacking force
of al-Qaeda in Benghazi? Once the compound
was overrun, the attackers were incensed to discover
that just two men had inflicted so much death and
destruction.The news
has been full of the attacks on our embassies throughout
the Muslim world, and in particular, the deaths of
Ambassador Chris Stevens and three others in Benghazi,
Libya.However, there’s
a little known story of incredible bravery, heroics, and
courage that should be the top story.So what actually happened at the U.S. embassy in
Libya? We are learning more about this every day.
Ambassador Stevens and Foreign Service officer Sean
Smith, along with administrative staff, were working out
of temporary quarters due to the fact that in the spring
of 2011 during the so-called Arab Spring, the United
States cut ties with then president Muammar Muhammad Abu
Minyar al-Gaddafi. Our
embassy was looted and ransacked, causing it to be
unusable. It is still in
a state of disrepair.
Security for embassies and their personnel is to be
provided by the host nation. Since
Libya has gone through a civil war of sorts in the past
18 months, the current government is very unstable, and
therefore, unreliable.
A well-organized attack by radical Muslims was
planned specifically targeting the temporary U.S.
embassy building. The Libyan security force that was in
place to protect our people deserted their post, or
joined the attacking force. Either
way, our people were in a real fix. And it should be
noted that Ambassador Stevens had mentioned on more than
one occasion to Secretary of State Hillary Clinton
(What Difference Does It Make Hillary Clinton),
that he was quite concerned for his personal safety and
the welfare of his people. It
is thought that Ambassador Stevens was on a “hit list.”
A short distance from the American compound, two
Americans were sleeping. They
were in Libya as independent contractors working an
assignment totally unrelated to our embassy.
They also happened to be
former Navy Seal’s.When
they heard the noise coming from the attack on our
embassy, as you would expect from highly trained
warriors, they ran to the fight. Apparently, they had no
weapons, but seeing the Libyan guards dropping their
guns in their haste in fleeing the scene, Tyrone Woods
and Glen Doherty snatched up several of these discarded
weapons and prepared to defend the American compound.
Not knowing exactly what was taking place, the two
Seal’s set up a defensive perimeter. Unfortunately
Ambassador Stevens was already gravely injured, and

CLINTON AND OBAMA AND OTHERS LOOKED INTO THE EYES OF
GRIEVING Mrs. Smiths eyes and lied to her about a You
Tube Video as the cause of her sons death know thing,
they never sent the security Ambassador Stevens asked
for, nor sent aid which it turns out were only 1 Hour
away) were overwhelmed by the sheer
numbers brought against them, an enemy force numbering
between 100 to 200 attackers which came in two waves.
The stunning part of the
story is that Tyrone Woods and Glen Doherty killed 60 of
the attacking force. Once
the compound was overrun, the attackers were incensed to
discover that just two men had inflicted so much death
and destruction.As it
became apparent to these selfless heroes, they were
definitely going to lose their lives unless some
reinforcements showed up in a hurry. As
we know now, that was not to be. I’m
fairly certain they knew they were going to die in this
gun fight, but not before they took a whole lot of bad
guys with them!
Consider these tenets of the Navy SEAL Code:

Battlefield,
3) Ready to Lead, Ready to Follow, Never Quit,

you both lived up to the SEAL Code. You served all of us
well. You were courageous in the face of certain death.
And Tyrone, even though you never got to hold your
newborn son, he will grow up knowing the character and
quality of his father, a man among men who sacrificed
himself defending others.

HACKING OVER AND OVER
About a week ago and for a day this editor had an
article up exposing the fact that this Journal was
hacked through links to Obamacare documents at HHS.
They were continually re-writing this page and the pages
that follow, placing new articles in the middle of the
page, changing words to make little sense, editing
whole paragraphs, removing my formatting, eliminated the
checkerboard background changing it to white and a
litany of other changes. The hacking was confirmed by my
terrific web host.
It was taken down because this editor just wanted the
powers involved to know the jig was up, and lets all
move on. Sadly, this editor placed a second
barrier to the first from a new vendor, and this morning
this editor found the article below and others were
re-written the old way. That barrier was taken
down and articles ARE AGAIN BEING checked, and
re-written! Folks, the
snooping continues, and it matters not who is doing it,
the question remains if our national security was
working, such hackers would be caught and stopped?
If you are typing along on your blog or newspaper
such as this Journal and your screen turns blue for an
instant, your key strokes were just recorded. Sorry NSA, but whoever is monitoring keystrokes which is
occurring, should be caught and prevented by you.

right mind would trust our Government nor any appointees

appears absent Eric, Barack is paranoid. What a
mess. Let's say one scandal comes up or another
failure act out and away from the affirmations that were taken to become
such and such a position and then fail to hear the
warnings of Benghazi from Benghazi actions against the
US, Britten and others, fail to secure us from attack on
a 911 anniversary, thus allowing us to get hit as if 911
never happened. It was not important enough for
Hillary, Barack, and many others, to see the errors of
our times, and be prepared for terrorist attacks.
They acted and continue to act as if neither 911 happened
but play lip service like tennis; You point out the
facts to Eric, Hillary, Barack or all the others, and
they attack back with how dare you, and your the most
blah blah blah, wasting the worlds time, and we never
get to the bottom of anything. That in and of
itself is antithetical to the
American Way.
Thus, knowing
American citizen innocents were injured by our
government on Barack's watch and it was all political as
heinous a thought that may be, stuff early NAZI legends
were made of, each and every wrong which occurs from
Benghazi-Gate to AP/Fox-Gate, to Snooping-Gate on to the
horrific IRS-gate, to the
Prostitution/Pedophilia/Drugs-Gate, and all the others
folks are anticipating to find, perhaps Obamacare-Gate,
because nothing was ever resolved by our government
relative to the fermented horrific problems, there will
and must be a time of complete transparency for the
American People, for Reporters, for our Media, so that
the public trust may be reestablished, for only a fool,
would let the conservatives and republicans be victims
of American Terrorism, and in time the tyrannical powers
will grow, and no one political party will be safe
especially, if a terrorist party came into office.
Are they Mad,
Slow, or simply the types of folks whose personalities
seem right but they couldn't solve a Rubik's
cube in short order if their lives depended upon it.
And these folks are handling the most difficult
assignments for our national security! Perhaps
there are more problems then "we the people" ever

THEIR OWN COUNTRY - FROM OUR LETTERS TO THE EDITOR SEGMENT FOR A WEDNESDAY
SPECIAL
If you haven't read about this yet, Shoshi sends in this
story of a 95 year old Pearl Harbor Survivor Hero and his letter sent to Barack Obama at
the White House.His story and letter follow:
Our WW II
95 year old Battleship sailor tells Obama to shape up or
ship out! This venerable and much honored WW II
vet is well known in Hawaii for his seventy-plus years of service to patriotic
organizations and causes all over the country. A
humble man without a political bone in his body, he has never spoken out before
about a government official, until now. The honorable
Harold Estes dictated this letter to a friend, signed it and mailed it to
the president.
Dear President Obama,
My name is Harold Estes, approaching 95 on December 13
of this year. People meeting me for the first time don't believe my age
because I remain wrinkle free and pretty much mentally alert.
I enlisted in the U.S. Navy in 1934 and
served proudly before, during and after WW II retiring as a Master Chief
Bos'n Mate. Now I live in a "rest home" located on the western end of Pearl
Harbor , allowing me to keep alive the memories of 23 years of service to my
country. One of the benefits of my age,
perhaps the only one, is to speak my mind, blunt and direct even to the head
man. So here goes.
I am amazed, angry and determined not to see my country die before I do, but
you seem hell bent not to grant me that wish. I
can't figure out what country you are the president of. You fly around the
world telling our friends and enemies despicable lies like: "We're no longer
a Christian nation" " America is arrogant" - (Your wife even announced to
the world," America is mean- spirited. " Please tell her to try preaching
that nonsense to 23 generations of our war dead buried all over the globe
who died for no other reason than to free a whole lot of strangers from
tyranny and hopelessness.) I'd say shame on the both of you, but I don't
think you like America, nor do I see an ounce of gratefulness in anything
you do, for the obvious gifts this country has given you. To be without
shame or gratefulness is a dangerous thing for a man sitting in the White
House.
After 9/11 you said, " America hasn't lived up to her ideals." Which ones
did you mean? Was it the notion of personal liberty that 11,000 farmers and
shopkeepers died for to win independence from the British? Or maybe the
ideal that no man should be a slave to another man, that 500,000 men died
for in the Civil War? I hope you didn't mean the ideal 470,000 fathers,
brothers, husbands, and a lot of fellas I knew personally died for in WWII,
because we felt real strongly about not letting any nation push us around,
because we stand for freedom. I don't think
you mean the ideal that says equality is better than discrimination. You
know the one that a whole lot of white people understood when they helped to
get you elected.
Take a little advice from a very old geezer, young man. Shape up and start
acting like an American. If you don't, I'll do what I can to see you get
shipped out of that fancy rental on Pennsylvania Avenue . You were elected
to lead not to bow, apologize and kiss the hands of murderers and corrupt
leaders who still treat their people like slaves. And
just who do you think you are telling the American people not to jump to
conclusions and condemn that Muslim major who killed 13 of his fellow
soldiers and wounded dozens more. You mean you don't want us to do what you
did when that white cop used force to subdue that black college professor in
Massachusetts , who was putting up a fight? You don't mind offending the
police calling them stupid but you don't want us to offend Muslim fanatics
by calling them what they are, terrorists.
One more thing. I realize you never served in the military and never had to
defend your country with your life, but you're the Commander-in-Chief now,
son. Do your job. When your battle-hardened field General asks you for
40,000 more troops to complete the mission, give them to him. But if you're
not in this fight to win, then get out. The life of one American soldier is
not worth the best political strategy you're thinking of.
You could be our greatest president because you face the greatest challenge
ever presented to any president. You're not going to restore American
greatness by bringing back our bloated economy. That's not our greatest
threat. Losing the heart and soul of who we are as Americans is our big
fight now. And I sure as hell don't want to think my president is the enemy
in this final battle...

ACTUAL CASES
FROM "TALES OF THE RAILS-RAILROAD CLAIMS STORIES" BY
NORMAN UDEWITZ- A NEW INFOJUSTICE JOURNAL SERIES WEEK
FOURTEEN
Introduction
Certain laws cover most employees
today who are injured while in the course of their
employment. Injured railroad employees are covered
and protect by a Federal Law, entitle the Federal
Employees Liability Act, also known as FELA. The
Jones Act is the only other federal law and it covers
maritime workers. Most other workers are covered
for injuries, which they incur during the course of
their normal and customary work duties, by State
Compensation laws, especially in California. This
is a "no-fault" system covering injuries, which arose
out of employment or during the course of employment
(AOE/COE).
Furthermore, under the auspices of
FELA, there is no formula to calculate monetary
compensation or to define for a jury what the limit is
in terms of the value that may be award for injuries.
Because of these pitfalls, many injured workers have
found that they can wreak a goldmine from the courts for
work-related injuries. This is not to say that
there are not many injuries which indeed deserve heavy
compensation relative to the losses which have been
incurred by workers, but it is to say that many workers
have found it all too easy to exploit the system and
bring home the gold, even thought they are still clearly
able to work and the injuries that they have incurred
are minimal.
The next section focuses on injury
cases involving the railroad. Approximately 90% of
the cases handled by the railroad actually involve
railroad workers themselves. Other cases involve
civilian bystanders who are incidental to the
injury-causing accidents.
FELA:
FEDERAL EMPLOYEES LIABILITY ACT
The following cases do not all
involve railroad workers but many do. Of the
current railroad inventory of cases some 90 to 95%
involve injures to their own employees with a portion
relative to civilians. These employee cases
reflect judgments and settlements involving the Federal
Employees Liability act (FELA).
There are two critical addenda to
the FELA, which are known as the Boiler Inspection Act &
the Safety Appliance Act.
The Boiler Inspection Act covers
ladders, handholds, brakes, safety appliances, lighting
and the cleanliness of the locomotive engine. The Safety
Appliance Act covers sill steps, ladders, handholds,
brakes, and other safety appliance and coupling
mechanisms, and all other safety appliances on railroad
cars. If there is a violation of either one of
these acts a judge in a courtroom would instruct the
jury to consider the railroad 100% negligent and the
only decision for the jury is how much monetary damage
to award. The only defense the railroad has is to
prove the plaintiff is faking or is involved in a
fraudulent claim if one of these acts applies.
CASES
AND INCIDENTS
RUDY THE
CHICKENHAWK
Rudy was a 53 year old supervisor of the labor desk
in Los Angeles. It was from this position that all
track laborers were employed. Rudy was also an
avid and obvious homosexual and had a taste for young
men.
A decision was made to build a large railroad yard at
West Colton, California, and Rudy received orders to
hire a large number of track laborers and put together a
steel gang for the project. It was later learned
that the makeup of this group of employees was totally
to Rudy's taste. Almost all of them originated fro
Rudy's hometown in Mexico and were illegal aliens.
The younger men had to share a bed with Rudy and the
older men had to pay him cash or do him other favors in
order to be employed.
In the union agreement there was a clause that
stated, after a person had been employed for 90 days
them must become a member of the Laborer's union and
were to be accepted as a permanent employee of the
Southern Pacific Railroad. Rudy had a unique way
of getting around this. At the end of 85 or 86
days, he would issue all of the track employees at West
Colton a notice that they were dismissed. The
following Monday they would all be rehired under a new
name and a new social security number.
Rudy's demise came about before the yard was
completed. It was discovered that a large amount
of machinery and tools were missing from the
construction site. The railroad police were
ordered to put a stakeout on the yard and determine what
was happening to the missing equipment. one of the
railroad policemen became suspicious and went to Rudy's
hometown in Mexico. He soon discovered a number of
bull dozers, Pettibone machines, cranes, trailers, and
other equipment that still had the Southern Pacific name
and number painted on them. In addition, he found
numerous hand tools and other materials that belonged to
the Southern Pacific. All of this was in Rudy's
hometown and was for sale.
The result was that Rudy was fired but remains on the
railroad as a legend and his name is still discussed in
railroad circles.
ONE BONUS FOR AVID JOURNAL READERS IS REFERENCED BELOW
FROM RAILROAD LEGENDS
THE MALATHION MAN
This man was a railroad policeman who was sent out on
a patrol in an area of Los Angeles that was infested
with the Mediterranean Fruit Fly. The city decided
to fight this infestation by spraying the area with the
pesticide Malathion from helicopters. The
policeman later alleged that he became ill from exposure
to the Malathion and filed a lawsuit. This lawsuit
was later settled for a nuisance amount.
His fellow police officers gave him the nickname of
the "Malathion Man" and it was said that he did not need
a flashlight on night patrol as he glowed in the dark.

Folks,
antithetical to my prototypical Letters to the Editor
section, since the author is unknown at this time, this
editor must opine, that there is nothing more moving
to follow my opinions below on how to stop
or further limit the financing of Terrorism and end the need to send our Soldiers to areas
of our world when the cause is Iran.
The following
is a wonderful and emotion inspiring tribute to the men
and women of our armed forces through a REAL LIFE EXPERIENCE
with commentary. And as a result or consistent
with this is a new movement
(Like the Dave Clark Five were in the 60's),
with its first sponsor SOUTHWEST
AIRLINES, IS GOING TO SUPPORT,
(Red Blooded American Warriors Support Day)
called "Red Fridays".
The unknown author begins with the
following:
Last week I was in Atlanta , Georgia attending a
conference. While I was in the airport, returning home,
I heard several people behind me beginning to clap and
cheer. I immediately turned around and witnessed one of
the greatest acts of patriotism I have ever seen.
Moving through the
terminal was a group of soldiers in their camos
(Short for Camouflage, a Garment made of Camouflage
fabric). As they
began heading to their gate, everyone
(well almost everyone)
was abruptly to their feet with their hands waving and
cheering.
When I saw the soldiers, probably 30-40 of them, being
applauded and cheered for, it hit me. I'm not alone. I'm
not the only red-blooded American who still loves this
country and supports our troops and their families.Of course I immediately stopped and began
clapping for these young unsung heroes who are putting
their lives on the line everyday for us so we can go to
school, work and home without fear or reprisal. Just when I thought I could not be more proud of
my country or of our service men and women, a young
girl, not more than 6 or 7 years old, ran up to one of
the male soldiers. He kneeled down and said 'hi.'
The little girl then
asked him if he would give something to her daddy for
her. The young soldier, who
didn't look any older than maybe 22 himself, said he
would try and what did she want to give to her Daddy.
Then suddenly the little girl grabbed the neck of this
soldier, gave him the biggest hug she could muster and
then kissed him on the cheek. The
mother of the little girl, who said her daughter's name
was Courtney, told the young soldier that her husband
was a Marine and had been in Iraq for 11 months now. As
the mom was explaining how much her daughter Courtney
missed her father, the young soldier began to tear up.
When this temporarily
single mom was done explaining her situation, all of the
soldiers huddled together for a brief second. Then one
of the
other servicemen pulled out a military-looking
walkie-talkie. They started playing with the device and
talking back and forth on it.. After
about 10-15 seconds of this, the young soldier walked
back over to Courtney, bent down and said this to her,
'I spoke to your daddy and he told me to give this to
you.' He then hugged this little girl that he had just
met and gave her a kiss on the cheek. He finished by
saying 'your daddy told me to tell you that he loves you
more than anything and he is coming home very soon.'
The mom at this point was crying almost uncontrollably
and as the young soldier stood to his feet, he saluted
Courtney and her mom. I was standing no more than 6 feet
away from this entire event. As
the soldiers began to leave, heading towards their gate,
people resumed their applause. As I stood there
applauding and looked around, there were very few dry
eyes, including my own. That young soldier in one last
act of selflessness, turned around and blew a kiss to
Courtney with a tear rolling down his cheek.
We need to remember
everyday all of our soldiers and their families and
thank God for them and their sacrifices. At the end of
the day, it's good to be an American.
RED FRIDAYS ----- Very soon, you will see a great many
people wearing Red every Friday. The
reason? Americans who
support our troops used to be called the 'silent
majority'. We are no
longer silent, and are voicing our love for God, country
and home in record breaking numbers. We
are not organized, boisterous or over-bearing.
We get no liberal media
coverage on TV, to reflect our message or our opinions.
Many American, like you, me and all our friends, simply
want to recognize that the vast majority of Americans
supports our troops. Our
idea of showing solidarity and support for our troops
with dignity and respect starts this Friday -and
continues each and every Friday until the troops all
come home, sending a deafening message that.. Every
red-blooded American
who supports our men and women afar will wear something
red.
By word of mouth, press, TV -- let's make the United
States on every Friday a sea of red much like a
homecoming football game in the bleachers.If every one of us who loves this country will
share this with acquaintances, co-workers, friends, and
family. It will not be long before the USA is covered in
RED and it will let our troops know the once 'silent'
majority is on their side more than ever; certainly more
than the media lets on.
The first thing a soldier says when asked 'What can we
do to make things better for you?' is...We need your
support and your prayers.Let's get the word out and lead with class and
dignity, by example; and wear something red every
Friday.

Here we come again
mmmm-mm-mm, Catch us if you can, mmmm-mm-mm,Time to get a move on, mmmm-mm-mm, We will yell
with all of our might... Now we gotta run, no more time
for fun... Well folks "Here we go again",
making all the mistakes of Libya, Egypt, arming Ben Laden, and too folks, too
many more examples.
If we arm the Rebels we will never be
able to prognosticate the outcome. If you have a snake, and cut off its
tail, it lives to bite us another day. If you cut off its head, well its a
"done deal". In other words join with our allies in the Region, and attack
Iran's Nuclear and Oil infrastructure. Cut off the money, arms supplies and
Hezbollah from fighting in Syria. That leaves Russia standing out like a
sore thumb, and if you know anything about Putin, he will do the SMART THING,
rather then the dumb thing, and work out a deal to keep his warm water Syrian
port, while either taking the Syrian President into Russia or at least removing
him from power.
It's all so simple unless our nation
wants Iran to get the Nuclear Bomb sooner rather then never, and wants' the
middle east to become one entire Terrorist controlled region of our world.
Yet our government leaps before it looks of late!
Over and over again
we
make life a drag. Yet if we appreciate the Dave Clark Five we can create
the prettiest world in mankind's experiential existence. Heck when I was a
very very young lad, singing in, Music man national troop but in the mid west
part of the tour and same part for my High School, a County play of Music Man
and others, later West Side Story, Oklahoma, and later still Once upon
a Mattress (Carol Burnett even came to see us; I got a
crush on her because she opined someone we know was cute while holding his
little face-The Jester singing and dancing the old soft shoe) and too many more, I loved the older girls dancing to the Dave Clark
Five. We can make an atmosphere in our world where the girls will dance
around the globe, rather then fearing to dance, show their faces, educate
themselves, marry the guy they love even in another religion, rather then
dooming middle east
womanhood to fear losing their heads to the blade for smiling at a nice young man,
and too much more.
Isn't this a nice light article
exposing some horrible threats facing our nation?
We are not at war with Syria. Thus we should not
continue to make the same mistakes of arming folks that
by the end of the experience, will turn the weapons on
us. From what this editor has read, Chemical
weapons are being used by both sides in Syria, and it is
time to cut off the head of the snake rather then the
tail. We must unify with our regional allies,
attack Iran's Nuclear programs and oil infrastructure,
to end their financing of death around the middle east.
But then offer Iran help if they turn to the side of
good. This ends two Iranian funded terrorist factions
outside of direct Iranian boots on the ground in the
middle east while ending the war in Syria. If
nothing else leave the oil as a carrot, and eliminate
the worlds fear of Iranian nuclear proliferation and
mass destruction as never witnessed before, as a stick
(Believe it nor not, it was

ROOKIES RUN ANTIFRAUD IN
THE US TODAY AT MANY LEVELS

My, my, my,
such classless yet paid well folks handle affairs better
left for professionals. Let me take you through
one groundbreaking case which as usual, was the first of
such cases in the State of California. Many years
ago, a ballot proposition passed which imposed a double
ability for folks to recover from a Drunk Driver.
You may ask how a Certified Forensic Medical and Fraud
Examiner Doctor of Chiropractic Orthopedics would be
involved in such a case. Welllllllllllllllllllllllllllllllllllllllllllllllllllllllllll,
Mama of the actually poor fellow who was a drunk driver
of 22 years of age was an IRS agent. The Attorney,
a retired LAPD Police Detective, was having a heck of a
time finding an expert witness who would and could
expose what he felt had been wrongdoing on the part of
the Victim. The most famous folks didn't want to
help the funding party, an IRS agent of some fame.
This examiner
received a call from the President of a National
Anti-Fraud Group explaining the difficulties involved,
and how hanky-panky may have occurred, and if I would
speak with the Attorney for the Defense. Which I
did. I liked the Attorney. He was very very
street smart, almost worldly at a local level if you
known what I mean, and had grave suspicions on what he
thought would be a simple throw yourself at the mercy of
the Court and land on your feet so to speak, if you
could case. This changed as our studies of the
case progressed.
The new law
allowed for the victim of a drunk driver to make full
recovery through the Insurance systems in play; damages,
repairs, and pain and suffering which was the original
law. However under the new law, the victim could
sue the drunk driver for addition pain and suffering,
inconvenience and time lost from work etc. And our
case occurred the day of the new law or some such manner
which made it a first trial test of the new law in the
Golden State.
Let me describe
the police report first. As the police came onto
the scene, immediately they spotted a trail of oil
running through the streets of LA. They followed
the oil for a few blocks, had to make a turn, repeat and
turn again when they spotted a vehicle pulled over to
the side of the road smoking. When they approached
the car, there was a very nice young man slumped over in
the drivers seat. They asked him if he had been in
an accident. He advised, something happened but he
wasn't sure what was going on. The young man had
been drunk.
Background of
the young man found a fellow who married very early in
life and had two twin blond daughters. Cute as
bugs in a rug (Old time talk
for very cute). He lost his first wife,
and had been at his own Bachelors party where he became
too intoxicated, and actually left early as he was
getting Married the next day. The young man
admitted everything to me during the several times we
met, and since we were going to trial in the Glendale
Superior Court, I was allowed discovery of medical
records and insisted on a personal examination of the
Victim.
During the
trial I was the last to Testify. During
examination, apposing council was almost hostel, but the
seasoned judge would not allow bigotry or biases in a
court of law. Either they gave me the respect I
had earned (Ist Ban in US
History of a Fraudulent Medical Device, Expert Witness
for Auto Club on a 350 million dollar class action suit
which my team won, rehired by State Justice to
attain a Federal alert to the old crime which had
resurfaced in 11 states violating trade across borders
for them or violations of interstate trade exporting
fraudulent medical devices, expert
Witness for the Grand Jury on a case involving
National Security issues, person asked to make lists of
potential Grand
Jury members for various cases beginning in Texas and
then moving around the nation by FDA, and too much
more), or they were disrespecting the law and
the court.
The Court room
was dead silent because no one was out of line or
disrespectful. If opposing council or any witness
was disrespectful to my degree they were disrespectful
to the Judge. During one question about the poor
victim and an alleged Surgery which my films showed no
Surgery but examination found a normal knee with a scar,
I responded with "could you please have the Victim walk
around the courtroom for us"? What an odd request.
Almost not granted but changed by the Judge to allowing
the Victims attorney to recall her and ask her to walk.
If this patient had a recent knee surgery of the day,
folks would notice something. However when she
stood up, flashed her legs with her miniskirt, prancing
like a gazelle around the court room
(The way she presented to my
office day's after her medical care visits; a gregarious
lovely silly and not with it but it worked great for her
women in my opinion, with a smile from heaven)...and had to explain why I only found a scar but no
surgery, the Judge looked at me like, "My god Doctor,
you did it". THIS EXAMINER WILL NEVER FORGET THAT
LOOK FROM THE SEASONED AND UNIVERSALLY RESPECTED JUDGE,
for as long as I live. His sophisticated and
commanding presence with thick white hair, face and look is engrained in my
memory to this day.
The case ended
with a Defense Verdict meaning no other payments outside
of Insurance were required on the case. After the
Judge hit his gavel and court was adjourned, I
thought the young man was going to kiss me. I had
to lean back and say "it's ok, it's ok, you deserved
nothing less".
Today, if you
are in any car accident in the Golden state, and it
becomes clear that you want your Doctor to be paid in a
timely fashion, you are to bill your own Med-pay, and
when the person causing the accidents insurance pays, if
they pay, the Big Insurance Carriers through you in the
middle, and you must pay back the med-pay if monies were
allowed.
Folks, the
greatest medical miscarriage of justice today I must
opine is the suppression of the fact that concussions
are common in Foot Ball, Rugby, and Auto Accidents.
It's a dirty little secret that somehow seems to be
industry driven rather then medically driven. If
you are hit, and you sustain a concussion, the system
throws you in the middle, when you are too sick, your
back is turned essentially, your guard is low,
comprehension is slow, and asks YOU, the victim to
handle all the financial affairs outside of simply
getting your own life back on tract. Outrageous!
Therefore, Insurance Reform must be revisited. All
insurance relative to the health of our citizenry, be
made whole in one fell swoop. And the fixes are
easy which is antithetical to Barack's Obamacare.
For example
back in the day, a quality insurance carrier had under
their employ, a reciprocity attorney. Each carrier
had one, and they made sure no inter-carrier financial hanky-panky was going on
and settled their own matters described above freeing
the waylaid and often injured victims to move on with
their lives. In fact the victim and the offender
go on with their lives. Somehow over the years,
the concept of reciprocity was abandoned, and from what
this editor is gathering, the appearing cold and callous industry
done consciously or unconsciously has never admitted this failure,
and to then life goes on...all while they were safe
hiding behind a job. And let me opine, you will
feel just as this examiner had, and want to take them
before a Judge so they can shoot their mouths off
(Classless paid and often
medically uneducated phonies), and allow a
verdict outside their constraints simply for being
anything but Professional Insurers. Perhaps I will
share a letter from one Head of Investigations for the
nation's largest Re-Insurer.
The
head of Investigations for one of our nations largest
Re-insurers writing to the Anti-Fraud police wrote, "Dr.
Neff has spent a considerable amount of time in his
practice perusing regulatory abusers of the medical
system throughout the United States. It is without
hesitation..."
This week a
letter was fired off to some folks, and the Insurance
Commission may be next. Perhaps the Governor.
From Auto to Work Comp, if they wish to listen, this
editor has the answers to solve the dollar loss
conundrum which faces the Golden State. Other
examples of how to solve the issue saved for the day,
the powers at be wish to work with this editor on
positive change for all folks. Intense study has
been put into these issues, and only through a combined
legislative effort, can we change the law forcing folks
of any corporation responding to the needs of our
citizens, to be as "ethical as they can be" and should
be, absent help. But help is needed.
Finally, creating a
couple of simple laws, which would disallow key tricks used
to build Workers Compensation mills or other folks from
ripping off the system, our government tax coffers, and
our citizens due to health fraud, is at hand if folks
wish to make change that will help all of us when we may
be the victim of a Auto Accident, a Dishonest Industrial
Mill, Dishonest Employer or anything which rips off the
medical system.
Perhaps this
editor will get the ball rolling if I receive positive
feedback. Obviously this examiner cannot give the

A large jet plane crashed on a farm
in the middle of rural Kentucky. Panic stricken, the local
sheriff mobilized and descended on the farm in force. By the
time they got there, the aircraft was totally destroyed with only
burned hull left smoldering in a tree line that bordered the farm.
The sheriff and his men entered the smoking mess but could find no
remains of anyone. They spotted the farmer plowing a field not
too far away as if nothing had happened. They hurried over to
the man's tractor. "Hank", the sheriff yelled, panting and out
of breath. "Did you see this terrible accident happen"?
"Yep. Sure did," the farmer mumbled unconcerned, cutting off
the tractor's engine. "Do you realize that is Air Force One,
the airplane of the President of the United States?" "Yep".
"Were there any survivors?" "Nope. They's all kilt
straight out", the farmer answered. "I done buried them all
myself. Took me most of the morning." "President Obama
is dead" the sheriff asked? "Well", the farmer grumbled,
restarting his tractor. "He kept a-saying he wasn't...but you

PRESIDENT OBAMA IN ACTION
Today, June 1st earmarks a call to
help maintain student loan rates by President Obama. Lets make
this very clear. If our Congress doesn't act, rates for new
Federal Student loans will double. And as anyone knows this
examiner, education has given me the opportunity to become a Doctor
in multiple health professions with vast experience to help my

morning, President Obama called on Congress to prevent federal
student loan rates from doubling on July1. Speaking from the
lovely Rose Garden, our President asked the students and young folks
in attendance to speak out in favor of action on college
affordability. Our President said, "Last year, you convinced
186 Republicans in the House and 24 Republicans in the Senate to
work with Democrats to keep student loan rates low. You made
something bipartisan happen in this town that is -- that's a
powerful thing. You guys were able to get Democrats and Republicans
to vote for something that was important. So this year, if it looks
like your representatives have changed their minds, you're going to
have to call them up again or email them again or Tweet them again
and ask them what happened, what changed?"
In his remarks, the President also
made a broader argument: Increasing access to college isn't just
good for the future of young people -- it's an imperative for the
nation at large. "Higher education cannot be a luxury for a
privileged few."
I seriously applaud
President Obama for seeing the importance of a good student loan
program which is friendly to the students and especially those who
must fund everything themselves.
Folks, lets support
President Obama on his thrust to keep the interest rates low for new
student loans, for our children are our future and the future of
this great Republic.

RADIOLOGY CORNER
A 64-year-old
woman had been treated by one of these new age shops popping up all
around the nation, on farms or in parks, where someone felt her
spine and manipulated her back joints (Pop and
Pray). Initially all she had was diffuse back pain and
a lumpy fat abdomen which was never examined. Although her
technician told her she was getting better she continued to decline
and her daughter asked her to see her DC. She presents to her
daughters Chiropractor complaining of a 3-month history of low back
pain, now with pallor, weight loss, hard stools, and crampy
abdominal pain. On physical examination, the patient has
hepatomegaly with palpable masses throughout the abdomen. The DC
immediately referred her for a CT scan as well as to the friendly
neighborhood lab for blood tests which demonstrated significant iron
deficiency anemia. The patient is now complaining of blood in her
stool. What is the expected 5-year survival for the patient?
The
dominant metastatic site for patients with CRC is the liver.

FROM "TALES OF THE RAILS-RAILROAD CLAIMS
STORIES" BY NORMAN UDEWITZ- A NEW
INFOJUSTICE JOURNAL SERIES WEEK THIRTEEN
Introduction
Certain laws cover most
employees today who are injured while in the
course of their employment. Injured
railroad employees are covered and protect by a
Federal Law, entitle the Federal Employees
Liability Act, also known as FELA. The
Jones Act is the only other federal law and it
covers maritime workers. Most other
workers are covered for injuries, which they
incur during the course of their normal and
customary work duties, by State Compensation
laws, especially in California. This is a
"no-fault" system covering injuries, which arose
out of employment or during the course of
employment (AOE/COE).
Furthermore, under the
auspices of FELA, there is no formula to
calculate monetary compensation or to define for
a jury what the limit is in terms of the value
that may be award for injuries. Because of
these pitfalls, many injured workers have found
that they can wreak a goldmine from the courts
for work-related injuries. This is not to
say that there are not many injuries which
indeed deserve heavy compensation relative to
the losses which have been incurred by workers,
but it is to say that many workers have found it
all too easy to exploit the system and bring
home the gold, even thought they are still
clearly able to work and the injuries that they
have incurred are minimal.
The next section focuses on
injury cases involving the railroad.
Approximately 90% of the cases handled by the
railroad actually involve railroad workers
themselves. Other cases involve civilian
bystanders who are incidental to the
injury-causing accidents.
FELA:
FEDERAL EMPLOYEES LIABILITY ACT
The following cases do not
all involve railroad workers but many do.
Of the current railroad inventory of cases some
90 to 95% involve injures to their own employees
with a portion relative to civilians.
These employee cases reflect judgments and
settlements involving the Federal Employees
Liability act (FELA).
There are two critical
addenda to the FELA, which are known as the
Boiler Inspection Act & the Safety Appliance
Act.
The Boiler Inspection Act
covers ladders, handholds, brakes, safety
appliances, lighting and the cleanliness of the
locomotive engine. The Safety Appliance Act
covers sill steps, ladders, handholds,
brakes, and other safety appliance and coupling
mechanisms, and all other safety appliances on
railroad cars. If there is a violation of
either one of these acts a judge in a courtroom
would instruct the jury to consider the railroad
100% negligent and the only decision for the
jury is how much monetary damage to award.
The only defense the railroad has is to prove
the plaintiff is faking or is involved in a
fraudulent claim if one of these acts applies.
CASES
AND INCIDENTS
ROMEO
Romeo was a 32 year old macho Hispanic track laborer
who had injured his back on the railroad and retained an
attorney who filed suit. He had not returned to
work, and during the disability period surveillance was
placed upon him. Film was obtained showing him
leaving his home with his children in the morning and
kissing his wife goodbye. He then drove to a grade
school and dropped off the children. Following
this he went to a public park and spent several hours
sitting on a bench in the sunshine and smoking marijuana
cigarettes. He later got in his car and drove to
his girlfriend's house where film was obtained showing
her kissing him in greeting and going into the house
with him where he spent about two hours. He then
drove to the school and picked up his children and went
home.
His attorney was advised of the film and even
furnished with a copy. The attorney called Romeo
and told him he wanted him to come to his office and
view the film without telling him what was on it.
Romeo first responded by saying that he had done nothing
wrong and he did not care, what film the railroad had,
as it could not affect his case. After further
argument he reluctantly agreed to come and view the film
but insisted that his wife accompany him. The
lawyer then told him he did not think it was appropriate
for wife to view this film, and he responded by saying
that his wife was a part of all family decisions and she
should be aware of everything before a settlement was
made. After further discussion the attorney
finally convinced him, to come to the office by himself
and view the film.
After viewing the film Romeo told his lawyer to grab
any settlement offer that the railroad was willing to
make. He also insisted on a promise that his wife
would never be made aware of this film nor allowed to
view it. The case settled for a very nominal
amount.

THE HAPPY HOOKER
A 28 year old man had entered into a business dealing with a street prostitute
in Los Angeles for cash and a check? Apparently he was unhappy with her
services and demanded his money back. She refused to return his money and
jumped into her automobile and started driving down the street. This
resulted in the man getting into his own automobile and chasing her. After
several miles they arrived at a railroad crossing with a train approaching.
The prostitute made it across the tracks in front of the train but her paramour
was not as lucky, and the train caused numerous injuries to him by striking his
vehicle.
He retained an attorney and filed a lawsuit against the railroad. During
the litigation period and for many months the railroad defense attorney
continually noticed the plaintiff's deposition. His attorney refuse to
produce him, coming up with numerous excuses and stalling tactics.
Shortly before the trial was to begin the defense attorney made a motion to the
court to force production of the plaintiff for a deposition. The judge
agreed and ruled in the railroad's favor. The plaintiff attorney
reluctantly admitted that his client was in the penitentiary on fraudulent check
writing charges. The defense attorney was able to go to the penitentiary
and obtain his deposition and it was then that the story of him chasing the
prostitute
came out. After the
deposition the plaintiff attorney filed a dismissal of his lawsuit and the trial

RADIOLOGY CORNER
A
previously well 7-year-old son of a
Doctor of Chiropractic's patient is brought to
the Chiropractors office with
increase limping for the last
month. He also complains of back and
groin pain that is worsened with weight bearing
and relieved by rest. The mother denies fever or morning
stiffness, and there is no history of trauma.
Patient vital signs are
normal. On physical examination his
back and groin are nontender to palpation, with
normal range of spine motion.
His left hip reveals
limitation on flexion, abduction, and internal rotation,
but notenderness, warmth, or
erythema. The boy is in the seventy-fifth percentile of
weight and height for his age. The rest of the physical
examination is within normal limits. An x-ray of the hip
is obtained. What is the most likely diagnosis?
Answer:
Legg-Calve-Perthes disease
Legg-Calve-Perthes disease, or avascular necrosis of the
femur, is an idiopathic and self-limited condition
which affects boys more then girls, with onset between
ages 3 through 12. Diagnosis is based on the
clinical presentation and x-rays. Remember this is
antithetical to a slipped capital epiphysis of the femur
which has a high association with obesity. One of
the hallmarks of Legg-Calve-Perthes disease is the
groin, knee pain or back pain which is referred from the
hip. When compartmentalizing this disease its
differential diagnosis would include slipped capital
epiphysis of the femur (which requires prompt surgical
treatment) , developmental dysplsia of the hip
(in
children under 10), lymphoma, bone tumors, osteomyelitis
and septic arthritis.
Remember in the child the best test is x-ray for hip
dysplasia or avascualr necrosis of the femur. In a
newborn the first diagnostic test for developmental
dysplasia of the hip is hip ultra sound
(instead of
x-ray). If
osteomyelitis is suspected, an x-ray will be falsely
negative within the first 2 weeks, so
the prudent DC must order a bone scan
(relatively
inexpensive and very sensitive,
but not very specific)
or an MRI (more
expensive but very sensitive and specific). The friendly neighborhood lab
or consulting Family Physician and Surgeon will
generally find elevated ESR and CBC
more times then not will show
leukocytosis.

Lets say our patient has a very strong family
history of ovarian and uterine cancer. Lab results show her
maxillary nodes also over express a 185 kD glycoprotein.
Remember this protein spans cell membranes and has intracellular
tyrosine kinase activity? What would be the function of this
protein?
Well, think of this protein as "accelerating cell
proliferation". This 185 kD glycoprotein was derived from
coding of our patients HER2/neu oncogene. Once this
glycoprotein has been translated it has intracellular tyrosine
kinase activity. It is a factor that controls epithelial
growth and differentiation. Thus over expression of HER2/neu
oncogenes are associated with increasing rates of breast and ovarian
cancer.

a now vacant senate seat could have a
Govenor appointee until 2014 which would have
given hope, peace, change, booming economies, truth and
too much more a chance to take
hold in New Jersey; a now
proven huge loss for the GOP, Christie will have a
special election securing another spinner and rejecter
of Americana to the senate. This is a
humongous
defeat
for the GOP hopefuls.
Governor Christie could have
PROVED HE COULD PICK THE RIGHT RUNNING MATE FOR VP by
appointing "just the right republican senator"
that the people would like.
But he failed...missed the opportunity, while life goes
marching on.
Yet Christie maneuvers theGOP like fly's are
attracted to bug zappers. The best comparison with
Barack.... cant.... this editor can't write it.
But maneuvering the people is a talent noted in both.
If the GOP has any
chances for saving America and reaching everyone, folks
of all ages, it has to be accepted as smarter, far more
reliable, far more trustworthy and more charming then
the
Donkey
Party. That means understanding Christie.
Look at the Donkey party folks in the senate today
blaming unproven things about Bush to reason its ok for
high level evil to criminally manipulate forensic
monetary tasks. The Jackass party today said
"two wrongs make a right"
even when their wrong was already admitted to,
apologized for criminal
manipulations, concomitant with an Audit which proved
wrongdoing, while they are again making allegations
against poor
George W. Bush, who did make mistakes, but had nothing
to do with comparable results. Today's Donkey
senate
was a damming impeachment for said party participants.
They think you (we
the
people)
are pretty darn stupid.
Fair-minded independent minds clearly see there is a
need for more conservatives and centrist moderate
republicans
in the Senate. These flakes can't pass budgets
yearly, and they expect to be paid! It is time for
the Congress to act responsible, and that may bring
other branches of the government back from the brink.
This week this editor received many jokes for my Monday
or Wednesday series but they prove a great anger
developing in the people, and
have to sorted by what this editor feels is the
limit of negativity.
Wellllllllllllllllllllll, absent any hurricane damage
excuse to support the Democrats into the White House,
Christie is making it too easy for another Donkey to get
into the senate and stop truth from solving the most
vexing problems to hit this nation since Water-gate.
The difference is Water-gate was a single, today our Big
government hit a triple and that is usually a sign of
only the tip of the iceberg for worry and sorrow by the
American people. Benghazi-gate, IRS-gate and the
Fox/AP-gate all at the same time! With the AG
making the biggest filmed faux pas to be kind, in
American history. A real TRIFECTA with dangling
participles, which must
be corrected and brought into the "light of truth", so
none of these things ever happen again. Christie
made it harder for folks other then Democrats to get
another Senate Seat. Why does the eastern
conservative media cut off their
noses to spite their faces blathering to fill the
air time on this issue? Wake up GOP.

FROM "TALES OF THE RAILS-RAILROAD CLAIMS STORIES" BY NORMAN UDEWITZ- A NEW INFOJUSTICE JOURNAL

The reader might wonder how a
railroad claim agent would get involved in this type of case and I
will try to explain. The railroad had a policy of allowing
their lawyers to handle outside cases not involving the railroad and
use their offices and secretarial help. This was done so that
they did not have to pay higher wages to the attorneys. The
attorney was allowed to keep any fees resulting from these cases.
A railroad drinking attorney was
the plaintiff attorney in this matter. He had met a gentleman
in his nightly rounds who was a part time Hollywood stuntman and
extra, and had in fact been in some of the Marlboro Cigarette
commercials in which cowboys had been involved.
This gentleman also considered
himself to be quite a gigolo, and he had met an extremely wealthy
lady who was going through a divorse from a very famous and
wealthy Chief Executive Officer of a major large corporation.
He met her at the Polo Lounge of the Beverly Hills Hotel and started
dating her. He also talked her into writing him a check for
$10,000.00. Following this they went on a weekend trip to
Reno, Nevada and stayed in a casino.
They had been doing a lot of
drinking and had gotten into a loud argument in the room.
During this argument she threw an object described as being ten
inches in length, five pounds in weight, cylindrical in shape, and
battery operated at him and struck him in the knee, tearing his
meniscus. This object was not her hair dryer.
He had to lose time from work and
get surgery on his knee. He retained the "drinking attorney"
to represent him in a lawsuit against the lady. The attorney
drew up a complaint and gave it to the plaintiff, who then went to
the lady's home in Beverly Hills and let himself in with a key she
had previously given him. She was having a dinner party at the
time and he grabbed her by the hair, shoved the written complaint
down the front of her dress and told her she was served with his
lawsuit.
The attorney did nothing more with
this case and several years went by. His client kept asking
him what was going on and he gave him various answers, telling him
he was ending interrogatories, taking depositions, and waiting for
the court to schedule a mandatory settlement conference and trial,
none of which was ever done.
The court ultimately dismissed the
case for lack of prosecution. The plaintiff then realized what
had happened and he retained another attorney and sued the "drinking
attorney" and the railroad. It was at this point that the case
was assigned to me.
The railroad General Attorney told
me he did not wish to put the railroad through any more problems
relative to this matter and wanted me to try to settle it for
$10,000. The "drinking attorney" was no longer working for the
railroad at this time, and he was in default for failure to answer
the complaint. I called the new attorney and offered him
$10,000. He told me his client would not accept this. He
was with a reputable law firm and I asked him why they would take a
garbage case like this, particularly when there was no liability
against the railroad. He would not answer my question except
to say that he felt the railroad was liable since we should have
supervised the activities of our attorney, in spite of the fact that
this was not a Southern Pacific case.
The case proceeded through the
courts and came up for a further settlement conference just before
trial. This was several years later. At the conference
the attorney said he would accept the $10,000 at this time. I
told him that the offer was now $5,000 as it had cost us $5,000 to
hire our own attorney and prepare for trial. He then
reluctantly accepted the $5,000 and this ended the case.
About a year later an article came
out in the newspaper advising that this same plaintiff had been
dying of lung cancer and received a large settlement from Marlboro
Cigarettes (Editors 2013 note: This
Marlboro case was on the national news when the smoking cowboy
received his award as well as most local TV outlets).
The same attorney that had handled the malpractice case against the
railroad represented him. It was obvious to me that had that
attorney not gone forward with the malpractice case he would have
lost all of his fees and the plaintiff from the lung cancer case.

Christie will govern like Barack. Hard Core Criminals collected
23 million dollars in less then two years while in a New Jersey
Prisons. Christie doesn't know anything about it, he never
heard about it nowhere no how, never studied it, he never
anticipated such old schemes, never put internal controls in place
to prevent it and THE BUCK DIDN'T EVEN STOP WITH CHRISIE, it went to
Criminals, illegally. Many folks from the West Coast and
center of the country can't see why the Eastern Conservative Media
can't see the forest for the tress with Governor Christie. He
is likeable but to what end?
Folks, this editor is not going to spend much time on this but it
gets the egg on the face of some in the East Coast Conservative
Press, acting like the liberal media which is evolving for the
better, although last night one of the big three Fox News pundits
took a shot at Rand Paul which this editor wont dignify. Lets
just add that it was a comment thrown against Paul, who had nothing
to do with the subject, but to sway her viewers away from Paul.
Folks, the conservatives, centrists and Independents have not
selected Paul yet. He doesn't have the "perfect" charm were
looking for but he has been right on many many of the issues facing
America. The choices occur when we see who is going to run.
Marco Rubio if he had the charm would be great. Mitt won't run
again but he should at least test the waters when the time comes.
He might find a heck of a lot of Democrats that wish they voted for
him. Jeb Bush is loved by conservatives, moderates and
centrists alike.
While this is the first Christie
ball to drop, from what this editor
gathers, many of the folks of his state never received enough money
to rebuild, were ripped off by their policies and Christie
was no
where to be found save seeming OVERLY chummy with Barack and always
when Barack has some controversy or election to deal with.
THAT IS ODD FOLKS. Hello!
Finally, no-one, no-one folks thought Christie's speech at the
Republican convention to elect Mitt Romney was anything more then
average, and a disappointment. Remember? Folks, that is
what conservatives remember. And then when he threw his brand
of Republican beliefs behind the President three day's before the
election (He could have waited a day to a few
days folks...) he became the shoehorn for Barack while the
public was deaf, dumb and blinded from the election tampering
resulting from IRS-Gate, Benghazi-Gate, and the attack against the
Fox news reporter, and no need for identification voting.
Inmate criminals do better then "we the people" while in jail
all in Christie's state under Christie's watch. And folks, "you
just can't make this stuff up".

does that mean because that is the crux of it all? It means he
is up to no good, and should not be in the neighborhood.
ZIMMERMAN CRIED WOLF AND THEN GOT HIMSELF INTO A SITUATION WITH POOR
INNOCENT AND NOT-SUSPICIOUS TRAYVON MARTIN, WHO WON THE DAY AND WAS
SHOT FOR BEING THE BETTER MAN. PERIOD. Zimmerman was
wrong from the outset and what the talking heads for Zimmerman are
saying is two wrongs make a right; wrong folks. There must be
something mentally wrong with poor Zimmerman because this has
nothing to do with white guys vs. black guys or innocent Hispanics
against black guys.
Zimmerman thinks he is a black guy. He took an Afro-American
women to his prom which showed guts. So in his mind based on
his past, combined with his MMA training, carrying a gun, and then
chasing down an innocent man absent identifying his true identity
would scare the be Jesus out of any sane man walking alone in the
dark while it was raining. Minimally it also demonstrates Zimmerman's
overly eager boldness

Narcissistic through his sense of entitlement and lack of empathy
for an innocent man-Trayvon...and now manifesting as an eating

again for the same Murder. Even the prosecutors did not think
things through, overcharged Zimmerman basically giving him a "get
out of jail free card", and well that means other folks will be
charged with being suspicious when their not and shot in self
defense. Its just that simple. NOTHING WAS LEARNED AND
NOTHING WAS GAINED BUT TRAYVON IS LOST AND DEAD AND HIS PARENTS WILL
FEEL THEY FAILED SOMEHOW THE REST OF THEIR LIVES albeit they were

SCALES FOR LAW AT ODDS IN
THE
ZIMMERMAN MARTIN TRIAL
UNBALANCED BY HUMANITY
and some might be saying

Lets say
a fellow who is a tough new
millennium teenager went
for a walk to smoke a joint
away from his folks.
And lets say he looked
suspicious by some profiling
standards
(As this editor
said, boxers and similar
athletes have since the
beginning of the sport ran
in gear which evolved to be
the so called "Hoodi").
And lets say an official
neighborhood peace officer
was on the pursuit of what I
still don't know, and caught
the fellow but never
revealed his authority or
that he was police officer
or was policing the
neighborhood. If the
fellows somehow fought and
as it happened the
undisclosed
peace officers butt
(broken
nose, and head banging
perhaps the oldest of the
prone position ground and
pound techniques dating back
literally to the
Gladiators) was
kicked, because the teenager
thought he was fighting for
his life to avoid robbery
from a stalker
and so forth, do you think at
this point the officer would
be off Scott Free if he shot and
killed the suspect?
There would have been
immediate review
(Albeit a trained Peace
Officer would never be
involved in such a crazy
situation, and have handled
things professionally). How
and why did the situation
escalate to the degree of
death?
It's tough folks. Is
life that un-precious.
Have the Terrorists won?
Did they change us to thirst
for death?
Now lets
say all of the above were
true save it is an
overzealous untrained gun
carrying
neighborhood watch
supporter, and he confronts
someone of far greater
fighting skill and ability,
and his aggression turns
weak, as he realizes he isgetting his butt kicked,
after a few yells for help,
its OK to stand your ground
and shoot the fellow?!
Or perhaps Zimmerman
pre-thought that if he got
his butt kicked he still
would have his gun to shoot
the teenager. It's kind of like throwing guys
like Wyatt Earp out.
Remember he would take his
gun and hit the butt end of
the gun on the head of
attackers. Not shoot
them! The killing
seems all too convenient
knowing George was packing.
And this editor would opine
a young innocent man was
killed in American
needlessly.
Guilty of winning a fight
between a teenager and a
grown man.
On the
other hand, the pictures of
Trayvon Martin submitted to
this Journal show a much
more troubled young man, and
you must realize the entire
media has been very
sensitive to the Martin's
and none have run Trayvon's
true pictures. Let's
say Trayvon had tried to
break into Zimmerman's
house, and a fight broke
out, it would have broken a
much higher bar of law;
protecting ones home and
family from invasion and
violent threat of a ass
kicking or the possibility
of death by the violent home
invader.
Much of
the case is sooooooo
suppressed, we actually
don't know exactly what
happened although they might
make a movie out of this
one. Can one be a
trained individual in the
Martial Arts and kick the
ass of someone who is
stalking you, and as it
turns out had a right to
walk home that evening, and
yet then be shot TO DEATH by
that once new device to make
men equal? The hand

Zimmerman shot too fast.
Yes Zimmerman ended up

of things, Trayvon had far
less time to determine his
intent then did Zimmerman,
and Trayvon might have
thought his life was in
danger, and demonstrated why

Zimmerman should have
followed far behind to see
what house Trayvon went
into. But again, we
really don't know what
happened? Or may never know
the full story or maybe we
have?
The trouble is absent
Trayvon, we don't know folks.
What we
do know is that from the
outset stupidity robed
Trayvon Martin of his day.
It began as a race case to
get the attention of law
enforcement. Then a
rush to judgment occurred
eliminating the Police
Chief. Mounting racial
tension ran through the
nation enough to get a burp
out of Washington as
President Obama gave his two
cents. Wrong wrong
wrong. Next it appears
too much lying to try to
protect Trayvon. He
probably was on top, and
probably was ending the
fight which is why Zimmerman
had time to grab his gun.
Georgi made things even didn't
he??????????????????????
Because
of all the human crap that
was thrown into this case,
it also has become a Leftist
vs. Conservative fight, a
Black against White fight,
folks are lying to help
Trayvon when left alone,
once the police realized,
Trayvon had the right to
return to his parents
domicile under the Florida
Constitution and the US
Constitution, he wasn't
armed, carrying illegal
drugs or wanted by the
police; he would have been
let go! If I were one
of them this editor would
have called for and made a
citizens' arrest thereby
detaining the assailant.
Why there
isn't even an allegation
Trayvon smoked a joint in
Georgi's neighborhood.
Get it? Hello.
This case should have been
tried simply on the action
causing Martin's pursuit,
and as it turns out
unjustified save he may have
smoked a joint evidenced by
a very low level of THC in
his blood? He was shot
for smoking a joint then or
in the past because we don't
know if he did smoke a
joint? Was he at a
party and breathed in the
tainted air? Folks we
simply don't know. Yet
he was the MAN THAT WON THE
FIGHT! No Drugs,
contraband, illegal anything
was found in Trayvon's
possession, unless his candy
was banned by a Florida Mayor
Bloomberg type or some other crazy
in vogue trend.
Somehow
this makes John Wayne, Clint
Eastwood and other great
movie representations of the
best of our tough guys look
like Wild Bill Hickok.
It was ok for a wimp to
shoot him dead save not in
Wild Bill's day!
Let this
editor know what you think
because it appears the right
is happy and the left is
beginning to worry, when we
didn't have Trayvon to
testify, and absent a far
better representation, tough
guys may have much more to
fear out of evil wimps as

travel in life. So
what if Trayvon was kicking
Georges butt. If they
were both alive and the
peace officers could have
separated them, finding out
Trayvon disposition in this
matter and what he was
doing, Zimmerman may have
been subject to a law suit.
But this
is just from the other side

when my honey

be in the dog
house again for simply
opining the ramifications
which may come forward from
a Zimmerman acquittal, and
wonder if somehow we just
could do better? I

spirits must be protected by
the rest of us because they
are so beautiful, they
wouldn't even know how to
fight. More often
women and children, but it
sure would be awful if we

Poor Juan Williams is paid to come up with anything to relate to the
left. Recently the AG stated he had to recues himself in a
matter. Juan, that means he can't look at the matter in an
unbiased way. Why? He is involved in some way.
Thus, when the AG indicated he knew nothing about any persecution of
the free press and a violation of the 1st amendment, and it turned
out he SIGNED OFF ON SUCH A MEASURE himself, that Pinocchio or to

EXPLAIN
Yes there were times this editor had
to sit through advanced classes in anti-cyber terrorism courses.
Yes the street was called IBM way and well that was one such
location. Others were at meetings for the Association of
Certified Fraud Examiners
(Now over 6 years retired from antifraud work)
and before that three national conventions all over a week in length
by the original anti-fraud seminars in the nation. Thus out of
date and disinterested let me guide you into the Chinese attacks on
everything we have.
Picture in your minds eye cyberspace. Picture a new world not
some set of computers. Remove any visualizations of ones and
twos or other nonsense. Picture a world like TRON for example
absent anything living as we know it. Behind the many screens
we normally see or conceive of, are more screens and more code.
Thus in your minds eye picture of cyberspace lets take perhaps the
secret code of Wacuta Engineering
(Just made that up so don't look for or if there is a Wacuta
Engineering its only an example).
In cyberspace what lives are
quadrillions (thousands of trillions) of codes and
you must simply find the code identifying Wacuta's computer.
That's is super easy. Now you want to get in. In
cyberspace you must find the computer then the codes are there as
walls of protections which are just code. Today often a worm,
virus, program or device to carry coding is loaded by both the spy
and the attacked as internal controls. If the defense is less
then the offence well, Wacuta would have just been attacked and
spied on.
What in the world has this administration been
doing? Before Barack we were the leader in technology.
Now with much of apple being made in China and too much more, it was
easy to get state of the art coding which was a US property, and
turn the tables on us. The single biggest threat to our
security is cyberspace attacks and terrorists attacks. Clearly
we are the loser to terrorist attacks, two in four months (Benghazi
and Boston) and clearly we are the loser to the Chinese.
This scandal should be as large as any of the other
scandals save this time our "everything" is being taken by the
Chinese were the others involve our Big Government eliminating the
1st amendment and spying obviously on anyone it fears. Our Big
Government fear us, "we the people" more then the Terrorists or
Chinese and what's' that all about? In any event, it should
have been a matter of national emergency to place new cutting edge
internal controls to prevent cyber-attacks against our Military and
its Industrial Complex, but no, our Big Government and loons in the
liberal media still think Voting absent any way to prove you are who
you say you are trumps, jobs, national security, a super economy vs.
it's improving although weakly. What a mess. What a
super mess. Our nation is not secure by real life events which
have transpired, and all the internal controls George W. Bush put in

time. This editor opines all senator's who sent such letters
to the IRS should be investigated for ethics violations.

Why is this trouble? Your elected officials are wasting their
time not addressing the real emergency issues which have faced our
nations over the last five years, and frankly the reason for all the
scandals and all the bad news about Terrorists succeeding and then
getting away with their dastardly deeds against America (Do you
really think two punks thought up the Boston Bombings(?)...come on!

Well to end this folks, we need to get our neighbors and relatives
informed so we have a national voice on real change in our nation.
And outside of the recent Catastrophes and Scandals which must be
investigated and gotten to the bottom of, we must unite no matter
our party affiliation. And if that means out with mission
impossible or Obamacare, so be it. We must work together and
eliminate all this evil which is facing our nation, get back on
track, rebuild our economy which

Good morning --
On Sunday, I was in Moore,
Oklahoma. Today, I'm headed to the Jersey Shore. Those two
communities are separated by half a continent but united by a common
sense of purpose. Like Joplin, Tuscaloosa, and New Orleans, they are
home to people who've seen nature at its worst and humanity at its
best. And they're filled with those who have made the choice to
rebuild after disaster, to come back stronger than ever.
The scene on the ground
this weekend was one we all know too well: homes wrecked and
neighborhoods devastated. But the memories I'll take away
from Moore will be of people standing tall, of neighbor
helping neighbor, of survivors working to ensure that no one
suffers through tragedy alone. And that too, was strikingly
familiar. I could have been back in Brigantine Beach after
Hurricane Sandy. I could have been in Joplin in 2011.
It's because of those past
experiences in places like New Jersey and Missouri that I
have faith that Moore will emerge from the wreckage of this
tornado stronger than ever. And that's in part because I
know that they won't undertake the road to recovery alone.
This was a national tragedy, and that demands a national
response.
If you want to help, the
best way to support those affected by this storm is to make
a financial contribution to the voluntary organization of
your choice. The best way to volunteer is to affiliate with
an organization that is already providing support to
survivors.

FROM "TALES OF THE RAILS-RAILROAD CLAIMS STORIES" BY
NORMAN UDEWITZ- A NEW INFOJUSTICE JOURNAL SERIES WEEK
TWELVE
Introduction
Certain laws cover most employees
today who are injured while in the course of their
employment. Injured railroad employees are covered
and protect by a Federal Law, entitle the Federal
Employees Liability Act, also known as FELA. The
Jones Act is the only other federal law and it covers
maritime workers. Most other workers are covered
for injuries, which they incur during the course of
their normal and customary work duties, by State
Compensation laws, especially in California. This
is a "no-fault" system covering injuries, which arose
out of employment or during the course of employment
(AOE/COE).
Furthermore, under the auspices of
FELA, there is no formula to calculate monetary
compensation or to define for a jury what the limit is
in terms of the value that may be award for injuries.
Because of these pitfalls, many injured workers have
found that they can wreak a goldmine from the courts for
work-related injuries. This is not to say that
there are not many injuries which indeed deserve heavy
compensation relative to the losses which have been
incurred by workers, but it is to say that many workers
have found it all too easy to exploit the system and
bring home the gold, even thought they are still clearly
able to work and the injuries that they have incurred
are minimal.
The next section focuses on injury
cases involving the railroad. Approximately 90% of
the cases handled by the railroad actually involve
railroad workers themselves. Other cases involve
civilian bystanders who are incidental to the
injury-causing accidents.
FELA:
FEDERAL EMPLOYEES LIABILITY ACT
The
following cases do not all involve railroad workers but
many do. Of the current railroad inventory of
cases some 90 to 95% involve injures to their own
employees with a portion relative to civilians.
These employee cases reflect judgments and settlements
involving the Federal Employees Liability act (FELA).
There are two critical addenda to the FELA, which are
known as the Boiler Inspection Act & the Safety
Appliance Act.
The
Boiler Inspection Act covers ladders, handholds, brakes,
safety appliances, lighting and the cleanliness of the
locomotive engine. The Safety Appliance Act covers sill
steps, ladders, handholds, brakes, and other safety
appliance and coupling mechanisms, and all other safety
appliances on railroad cars. If there is a
violation of either one of these acts a judge in a
courtroom would instruct the jury to consider the
railroad 100% negligent and the only decision for the
jury is how much monetary damage to award. The
only defense the railroad has is to prove the plaintiff
is faking or is involved in a fraudulent claim if one of
these acts applies.
CASES AND
INCIDENTS
THE TRAUMATICALLY
DEPRESSED CONDUCTOR
A 32 year old conductor was
driving a company owned auto, which was used in the rail yard to
facilitate train movements. The vehicle had a history of
kicking out of the park gear when left with the engine running.
His claim was that he had driven to the train to attach an end of
train device currently used by railroads in lieu of a caboose.
It can be carried and attached by one man. He parked the
vehicle on the edge of a dirt road next to a ditch. He then
got out of the vehicle and alleged it kicked out of the parking gear
and rolled toward the ditch. He jumped into the vehicle to try
to stop it, which failed, resulting in the vehicle rolling into the
ditch and onto its side.
In addition to a neck injury, he
claimed he was clinically depressed to the point of being suicidal
and mentally unbalanced. He retained an attorney and filed a
lawsuit. The case was then assigned to me and I learned that
he had been boasting that he would get one million dollars and
retire. I entered into extensive investigations to prove he
had been mentally unstable for a long time prior to the injury.
I learned that he had been married six times, although he testified
he could not remember how many times he had been married, and it had
been his M.O. to move in on a woman who was at a troubled time in
her life and then take over running her life with subsequent
marriage.
I started out by talking to his
ex-wife #4. She advised he appeared at the time she was
getting a divorce from her first husband. He completely
destroyed her life by his actions. He was insanely jealous,
would check the odometer to see how many miles she drove, check her
vehicle for fingerprints, and would follow her around and confront
her at the work place in an accusing manner. She divorced him
and sought out psychiatric care.
She gave me leads to other bizarre
acts by this man and I obtained a statement from a railroad clerk
that he had threatened to throw out of a tower in a fit of jealousy.
The Trainmaster would call her in to take dictation and he would
burst in and embarrass her. I took his statement with a court
reporter as well.
She
told me that he kept a small suitcase
with pornographic tapes and ejaculation cream. In addition he
would not allow her to see him in a state of nudity. She also
gave me leads to other ex-wives and other persons at the railroad to
substantiate the bizarre acts.
I talked with her ex-supervisor
who confirmed the conductor was insanely jealous and disruptive to
business. Relative to liability I found a Denver switchman,
who formerly worked with the conductor. He advised that two
weeks prior to the case accident, the conductor had driven the same
vehicle into the same ditch and was later pulled out by locomotive.
H did not file a claim for the first incident, and no written report
was made.
I also learned from a brakeman
working the day of the incident that he observed the conductor
driving the vehicle down the dirt road raising a cloud of dust and
go into the ditch without making a stop, thereby negating the
plaintiff's version of the accident.
I then spoke to the first ex-wife
and son. The ex-wife stated he was very domineering and often
acted in a bizarre manner. The son broke down into tears,
saying he felt that the father abandoned him at an early age.
In fact, when one of the son's children died of crib death, the
father did not come to the funeral.
When the plaintiff attorney
learned about the information I uncovered the case settled for less
than one million dollars. The settlement figure was $200,000
and the conductor resigned.
On an extremely bizarre note two
months later, I read in the paper that the son had been arrested for
murdering his mother and two children. This same son had told
me he would be more than willing to testify about the father's
bizarre actions as well as would the mother.
Prior to the murder, when the case
settled, I called both of them to tell them that they would not have
to go to court and thanked them for their help.
The police who investigated the
murder of the mother found evidence of foul play. Further, when they
added it up they discovered both his children died on the same date
in different years. The date coincidentally was the father's
birthday. Both children died of crib death allegedly, but
further testing showed they had been
smothered by a pillow, as had his mother.

dislocation. Gouty arthritis may have lumpy masses,
synovial chondrometaplasia may have soft tissue masses
and dysplasia may have bowing deformity of the metcarpal
bones. 2b.
Soft tissue densities are spherical in shape with
radiolucent center, most compatible with phleboliths.
Loose bodies should not be found outside of hte joints.
Shrapnels should be found next to broken bones.
Hydroxyapatite crystals should not be hollow at the
center. 3c.
Mafucci syndrome can explain the bowing deformity of the
boens, the radiolucent lesion inside the bones, the soft
tissue densities as well as the mass effects. Gouty
arthritis is a mimmicker, but lack actual joint erosion.
Most of the lucent lesion inside the bones are not
attended by joint changes. Synovial chondrometaplasia
may marginally explain the soft tissue density
increase but not the intrinsic radiolucent bony lesions
and the bowing deformity of the metacarpals. Shrapnel's
from bomb injury is not likely due to all the intact
bones without actual fractures.

HAPPY MEMORIAL DAY AND PLEASE WATCH YOUR CHILDREN
Memorial Day is
a blessed day which occurs every year on the final Monday of May.
We celebrate Memorial Day in remembrance of the men and women who
died while serving in our Armed Forces. This is very thought
provoking holiday this year as we must morn the deaths of our Libyan
Ambassador, and all the heroes that died needlessly and were left
behind without even the good old American try to help them over the
many many hours spanning two attacks by al-Qaeda terrorist linked
organizations. And the Islamic Terrorists were never caught.
Many people
visit cemeteries and attend memorials as well as placing an American
flag on each grave in
national cemeteries. However please remember that this is
the first holiday when the sun is warm, and it is often the first
chance in the year, to run and jump into an outdoor swing pool,
pond, lake, ocean or reservoir. Children excited to get into
the water (oceans, lakes, rivers, and swimming pools) sustain serous
neck and spine injuries including death. Please supervise any
out door water sports such as waterskiing, surfboarding and so
forth. If you or your children compete in a new spring event
which requires exercise, warm up, stay out of prolonged sun
exposure, and bring electrolytes or even a combination of the simple
salts such as table salt, and kosher salt for their sodium and
potassium respectively. Gator-aid and Gator-aid like drinks
will suffice.

IGNAZ SEMMELWEIS MD
INTERESTING
PERSON IN TIME
Ignaz Semmelweis also known as Ignác
Fülöp Semmelweis, was born at Budapest Hungary on the
1st of July 1818, and was educated at the universities
of Pest and Vienna. He graduated with his M.D.
degree at Vienna in 1844, and was then appointed
assistant professor in the maternity department, under
Johann Klein.
Ignaz became a famous obstetrician
through his brilliant observations and implementation of
procedures deemed mandatory in today's hospital care and
surgeries. Unfortunately he had to suffer under
the egocentric hubris and lack of gratitude of his
supervising professor. For example deaths from
puerperal fever were ominous. While employed as
assistant to professor Klein of the maternity clinic at
the
Vienna General
Hospital in
Austria in
1847, Semmelweis introduced hand washing with
chlorinated lime
solutions for interns who had performed
autopsies. This immediately reduced the
incidence
of fatal puerperal fever from about 10 percent (range
5–30 percent) to about 1–2 percent. Further while
working in Johann Klein's department, between October
1841 and May 1843, of 5139 parturient women 829 died,
yielding the terrible death-rate of 16%, not counting
those of patients transferred to other wards.
During Ignaz matriculation through clinical clerkships
(Please remember that your editor was recently trained

Hospital for my Clinical Clerkships in Medicine-You
learn more than anyone can imagine unless they to are a
Doctor of Medicine, Nurse and so forth...)
he observed that certain patients would die in rows,
others escaping and that women delivered before arrival,
or prematurely, would escape such fates.
Ignaz tells us that the final clue came
from the death of a colleague from a dissection wound,
and in his words "unveiled to my mind an identity" with
the fatal puerperal cases and through inductive and
deductive reasoning believed that the causation was due
to septicemia. In May of 1847 the mortality stood
at 12.24% in Klein's ward. On his own initiative
Ignaz again prescribed his ablutions with chlorinated
lime water and before the end of the year the mortality
rate had fallen to 3.04% and in the second year to 27%!
He had earned the title the "saviour of
Skoda and other eminent physicians were
convinced by these results. Semmelweis' hypothesis, that
there was only one cause, and it was relative to
cleanliness, was extreme at the time, and was largely
ignored, rejected or ridiculed. The hubris Klein
his supervisor apparently blinded by jealousy and
vanity,
(Still an experience to some research inclined medical
students today),
pontifically dismissed him from the hospital and caused
the medical community in Vienna to force him to
move to Budapest in 1849.
Fortunately, in the following year he
was appointed obstetric physician at Pest in the
maternity department which had been as terribly
afflicted as Klein's wards had been. Again Ignaz
begot utility of his methods and during his six years
tenure of office he succeeded, by his antiseptic
methods, in reducing the mortality to 0.85%. Yes 0.85%.
Sadly Ignaz albeit tender-hearted and
irascible, was an unmotivated author, and thus there is
no doubt his opinions would have become in vogue much
earlier in our medical development. Ignaz
was outraged by the indifference of the medical
profession to the concepts of cleanliness and scrubbing
before surgery and began writing open and increasingly
angry letters to prominent European obstetricians, at
times denouncing them as irresponsible murderers. His
contemporaries, including his wife, believed he was
losing his mind and he was in 1865 committed to an
asylum
(mental institution-EDITOR'S NOTE-FIGURES!).
Ignaz died there only 14 days later, possibly after
being severely beaten by guards.
Ignaz' principles and
practice only earned widespread
acceptance years after his death, when
Louis
Pasteur
developed the
germ
theory of disease
which offered a theoretical explanation
for Ignaz' findings. Today Ignaz
is considered
the preeminent pioneer of
antiseptic procedures.
Thus, obstetrician
Iganz Semmelweis MD
will forever be remembered for being the first physician
and surgeon to demonstrate a 5-fold reduction in
puerperal sepsis by hand washing between performing
postmortem examinations and entering the delivery room
and a reduction in the death of patients from 12.24% to
that of 0.85% from pathogenic contaminations.
Thank God for the early "heroes of health care",
especially "Ignaz Semmelweis MD", and all those that in
some way progressed science, the learning of others, the
advancing of new inventive methods of medicine which
improved our health, welfare and

editor opines a fear, that mothers will mean nothing but symbolism for a
plausible deniability

encouraged in our schools and our government, lying to suit a political
situation over the health and welfare of our nation, will doom us to an ever
shrinking power relative to foreign powers who have been jealous for years, and

Independents, find yourself a candidate, because it is
clear from the Romney debacle, the East Coast Republican Media will press for
the shoe horn for Obama politically the week of the election and poor health
model for our nation Governor Christy, while the West Coast and Central states
Republicans will never go for a liberal in sheep's clothing. Truly about
one third of the folks are democrats and they will PROBABLY be united behind
their candidate, while another one third of the folks are Republicans, and they
will be divided to the extent that less money will flow to Christy on a national
basis then Romney, and even more conservatives may either not vote as they did
with Romney or give the Democrat a chance. That leaves over one third of
the folks who are Independents to settle the next election.
One would think after the worst government in recent
memory, a republican would be a shoe in. But Christy is linked to Obama
forevermore, with all the spying, and story telling, and suppression of the
truth with a spin story told to the American people time and time again.
Folks, somehow BARACK HAS SEEMED LOVEABLE UNTIL NOW,
where Christy is anything but the most charming politician since Reagan,
President Barack Obama. Well folks, if you have an idea how to unite
Americans again, and bring back the old fashioned American pride which our new
Big Government has never had, changed the DOJ colors from Red, White and Blue to
Black (?), Obama speaking out against our founding fathers
warnings of
too Big of a Government and every chance he gets, it is clear to folks who loved
our nation and our heritage FOR WHAT AMERICA IS, are left out in the cold by our
present Big Government for change of a communist-like government which has
failed historically every time it was tried. And with much pain to the
citizens. Look at the Judge who just ruled against the best Sheriff in our
nation, Joe Arpaio
(Poor honest hard working law-abiding

Now being a peace officer is a violation of made up laws not on the books.
Just ask our Border Patrol Agents and they will tell you they are not allowed to
enforce the laws on the books!
If you want to protect your mothers, and protect our
Journalists from the real threat of being accused of criminal activity for doing
their jobs, and bring TRUE justice back to America, it is time for change away

PRESIDENT OBAMA URGES IMMIGRATION REFORM
Yesterday President
Obama made a passionate plea for immigration
reform. This editor would opine that
once the Southern Border was secure
(and there were guarantees in place that we
would not have a repeat of the last amnesty
program authorized by President Reagan, only
to find that after he passed, none of the
promises the Democrats made to him to seal
the deal were ever made, which caused a
repeat of the same problem)
then immigration reform would be in order.
In other words Republicans set the people
free, only to have the Democrats break every
promise the compromise was built upon, which
caused the immigration problems we have
today.
In any event, our
president made a plea for immigration reform
yesterday which has received zero in the way
of press. Thus you decide if the
Borders are secure at this point and such a
plea is forthright. The presidents
plea follows:
"I congratulate the
Senate Judiciary Committee on completing its
work on S. 744, the Border Security,
Economic Opportunity, and Immigration
Modernization Act. Thanks to the leadership
of Chairman Leahy and a bipartisan group of
eight Senators, the legislation that passed
the Judiciary Committee with a strong
bipartisan vote is largely consistent with
the principles of commonsense reform I have
proposed and meets the challenge of fixing
our broken immigration system. The process
for considering this legislation has been
open and inclusive with multiple hearings,
and more than a hundred amendments were
considered and adopted, in many cases with
bipartisan support. I applaud the Committee
members for their hard work, especially
“Gang of Eight” members Senators Schumer,
Durbin, Graham and Flake. None of the
Committee members got everything they
wanted, and neither did I , but in the end,
we all owe it to the American people to get
the best possible result over the finish
line. I encourage the full Senate to bring
this bipartisan bill to the floor at the at
the earliest possible opportunity and remain
hopeful that the amendment process will lead
to further improvements".

PHARMACOLOGICAL SCIENCES CORNER
A new drug inhibits
a step in "fatty acid oxidation" and
is considered promising for the treatment of
stable angina. What would be the
mechanism of benefit?
Less oxygen use
per
one ATP synthesized. Fatty
oxidation inhibitors are new agents that
inhibit fatty acid oxidation and shift
energy production to glucose
oxidation thus promoting oxygen
efficiency. This not only decreases
the amount of oxygen needed to
support cardiac function but also
decreases potentially toxic fatty acid
metabolite production.

Of course a short audit
of what has been reported demonstrates why
reporters from the big press to the smallest
blogger united in outrage against AP-Gate.
There was never
a huge national security issue or reason to
spy and record AP's contacts.
Presently the time line breaks down to AP
had a story and went to CIA for clearance.
CIA asked AP to hold the story for five days
and to make a long story short, CIA then
advised it was no longer a national security
issue but wait another day. Since it
was verified as not being a national
security issue, and the news must reach "we
the people", AP printed the story.
Snooping not national security caused
contacts and secret contacts for most all
stories during the period requested was
audited and recorded by Big Government and
of course these contacts will leak out in
time. This is snooping of AP for not
waiting after it was told the story was
cleared by CIA as not a national security
issue; inconsistent. Was Big
Government correct telling a judge it was a
national security issue at that point?
Isn't that perjury? As the White House
taught us, it was old news by that point in
time and cleared folks.
Now relative to the IRS commissioner who
retired at his convenience as he wanted to
leave but was only staying another few
months to fulfill his contract, he was
abusive to congress and his arrogance showed
him above law. In other words he left
early conveniently for image rather then
being fired and proved a hostile witness
in contempt of congress and with contempt
for congress. But I have a question.
What kind of a lunatic would put contact
with the most feared agency we have with
folks who are ill? They could drop
dead of a heart attack from stress if feeble
from illness simply being contacted by said
agency The last Big Government agency
one wants to hear from when their sick,
suffering, poor, weak, helpless, disabled,
and so forth is the IRS. Placing the
IRS in the HealthCare equation in and of
itself is an oxymoron and thus this
editor would opine by a moron; inconsistent
relationship which demonstrates a disregard
for the American people. It was a cold
and callous decision to bring them into our
health matters. Finally the AP actions
by Big Government appear a hoax. Which
is why the entire case needs to become fully
transparent and open.
Well, let us hope that some decent folks
save America and bring our monster
government back under the achievable goal of
control. Why even President Obama's
most stanch advisor indicated
(The honorable David Axelrod), the
government has grown too large for anyone to
know what is going on.

LETTERS TO THE EDITOR
How dumb are we??? So now we find
out that the entire Tsarnaev family (Dad,
Mom, 2 sons, 2 daughters) started receiving
government assistance as soon as they set
foot in our country. As political refugees
they were entitled to settlement assistance
from day one. (Section 8 Housing, public
healthcare, food stamps etc.)
Then
their stellar older son impregnates and
marries the daughter of a doctor, and this
new little Muslim family receives 18 months
of government assistance. They only came off
welfare after the naive young wife starts
working 70 hours a week while husband
Tamerlan stays home and builds bombs and
plans to kill and injure the very Americans
who have paid for his pathetic existence for
the past 12 plus years.
A Breakdown

Family:
Section 8 housing
Free public healthcare
Food stamps and other EFT transfer
payments
Federal Pell Grants for both sons and
most likely their daughters as well.
(That is $5200.00 per year for each son or
daughter who attended a college.)
City of Cambridge also awarded a $2500
per year scholarship to the younger son.
Younger son also reportedly was receiving
state college scholarship.
What did we receive for our investment:
· Older son was arrested for domestic
battery on a former girlfriend. · The
mother was arrested last year for
shoplifting $1600 in merchandise from a
Lord & Taylor store. Mother is facing
immediate arrest for failure to appear
regarding this matter. · Then of course
we know that the two sons combined to kill
four people (3 Americans & a Chinese
exchange student), severely injure 100
plus other people, carjacked another victim
and only let him live when they found out
that he was not an American citizen. ·
Now we have the two pathetic parents who
have returned to Russia and are claiming
that their poor sons are innocent and are
being framed by the same American government
that allowed for their pathetic existence
the past 12 plus years.
When are we going to put a stop to this
madness??

JOSEPH LISTERINTERESTING
PERSON IN TIME

oseph
Lister was born in Upton,
Essex, England, on April 5,
1827. He was the second of
three children born to
Joseph Jackson Lister, a
very successful wine
merchant and amateur
scientist. Joseph Jackson
Lister’s design of a
microscope lens which did
not distort colors opened
the way for the microscope
to be used as a serious
scientific tool. This
contribution to science
resulted in Joseph Jackson
Lister’s being made a Fellow
of the Royal Society—the
prestigious British
association of experimental
scientists.
Young Joseph
attended Quaker schools in
Hertfordshire and London,
where science subjects were
emphasized. Following
matriculation, he obtained a
Bachelor of Arts degree at
the University of London in
1847 and by 1850 he obtained
his Bachelor’s degrees in
Medicine and Surgery, and in
the process won two
university gold medals for
his outstanding marks.
Further study saw Joseph
easily pass the examination
to become a Fellow of the
Royal College of Surgeons
(FRCS) in 1852.
It is
interesting to note that
modern surgery as we know it
today was not able to
develop until three great
obstacles had been overcome.
These were first and
foremost, the control of
bleeding. Second, the
control of pain. And
third and not least of all,
the control of infection.
In 1552, a leading French
doctor, Ambroise Pare,
developed and systematized
the idea of tying off the
ends of broken or cut blood
vessels with threads called
ligatures in order to
minimize bleeding. The
control of pain through
anesthesia was just being
introduced during the time
when Joseph was a university
student. Before this,
surgery had involved agony
for the struggling patient,
which in turn meant that
doctors had to operate as
quickly as possible.
The
introduction of anesthetics
opened up a new era in
surgery, as doctors were now
able to take the time
necessary to improve their
techniques. The third major
hurdle, the control of
infection, remained
unconquered when Joseph
began working as a surgeon.
Joseph, in 1853, went to
Edinburgh, Scotland, to
spend four weeks with
Professor James Syme, who
was considered to be
the
greatest teacher of surgery
at that time. Joseph soon
decided to stay in Edinburgh
as Syme’s assistant. Three
years later, he married
Syme’s daughter Agnes.
While still
a student, Joseph had
decided not just to practice
medicine, but also to
conduct research to improve
medical knowledge. His early
investigations explored the
action of muscles in the
skin and the eye, the
mechanism involved in the
coagulation of blood, and
the role played by blood
vessels in the early stages
of infection. Joseph's
research required frequent
use of a microscope—a tool
very familiar to him because
of his father's involvement
with it. His research
required considerable
sacrifice and dedication, as
it was undertaken at night
after he had completed a
full working-day in the
hospital wards. Recognition
of Joseph's early research
came in 1860, when he was
made a Fellow of the Royal
Society, the same honor that
had been bestowed upon his
father.
In the
Edinburgh Hospital where
Joseph worked, almost half
of the surgery patients died
from infection. In some
hospitals in Europe, as many
as 80 per cent died. While
surgeons regretted this high
death rate, they trained
themselves to accept this
unpleasant aspect of their
work. After all, they
thought, nothing could be
done about these infections,
because they arose
spontaneously inside the
wound. Joseph however, was
not convinced of the
inevitability of infection
(which was also known as
sepsis). He began to search
for a way of preventing
infection—that is, an
antisepsis method.
Joseph's
first clue as to the cause
of infection came from
comparing patients who had
simple fractures with those
who had compound fractures.
Simple fractures do not
involve an external wound.
These patients had their
bones set and placed in a
cast, and they recovered.
Compound fractures are those
where the broken bone
pierces the skin and is
exposed to the air. More
than half of these patients
died. Joseph reasoned that
somehow the infection must
enter the wound from the
outside. But how exactly did
this occur? And what could
be done to prevent it?
Joseph began
washing his hands before
operating
after hearing about the
great obstetrician Iganz
Semmelweis MD's hand washing
procedures (Scrub in prior
to surgery.), and wearing
clean clothes. Even
though Joseph's procedures
were scoffed at by some of
his colleagues, who
considered it a status
symbol to be covered in
blood from previous
operations, his talent was
becoming recognized. In 1860
he became Professor of
Surgery at Glasgow. There, a
friend lent him some
research papers by the
outstanding French chemist,
Louis Pasteur.
As the son
of a wine merchant, Lister
was all too familiar with
the problem of wine going
bad because of faulty
fermentation. Pasteur had
shown that the problem was
caused by germs which
entered from the air, and
that organisms did not come
to life spontaneously from
non-living matter within the
wine. Thus if germs entering
from the air outside the
wound caused infection (in
the same way that the wine
became contaminated.) then
those germs could be killed
and infection prevented.
Pasteur had
used heat and filters to
eliminate the germs in the
wine, but these techniques
were not suitable for use
with human flesh. Instead,
Joseph learned that carbolic
acid was being used as an
effective disinfectant in
sewers and could safely be
used on human flesh.
Beginning in 1865, Lister
used carbolic acid to wash
his hands, his instruments,
and the bandages used in the
operation. Lister also
sprayed the air with
carbolic acid to kill
airborne germs. After more
than a year of using and
refining these techniques,
Lister had sufficient data
to show that his methods
were a success. He published
his findings in the medical
journal, The Lancet, in
1867.
Two years
after publishing his
findings, Lister returned to
Edinburgh to become
Professor of Clinical
Surgery—the position
formerly held by his eminent
father-in-law for more than
three decades. Lister
introduced his antisepsis
procedures in Edinburgh and
again met with dramatic
success. However, widespread
acceptance of Lister’s
procedures was rather slow,
as is often the case with
revolutionary new ideas.
Some busy doctors were
unwilling to take the time
to even consider new ideas.
Some found it difficult to
believe in germs—living
organisms that wrought havoc
but were too small to see.
Others tried Lister’s
procedures, but did so
incorrectly and therefore
failed to obtain the desired
result. (Part of the reason
for this was the complexity
of Joseph's procedures and
the constant modifications
he made to his system in
order to improve them.)
Also, Joseph's method added
to the expense involved in
dressing wounds.
Joseph was
neither angered nor
discouraged by the
controversy that raged about
his work. Instead, he went
on his gentle, unconcerned
way saving his patients and
trying to cheer them while
doing so. And
over the next 12 years,
Joseph's methods gradually
gained acceptance. Doctors
from Denmark and Germany
were the first to implement
Joseph's antiseptic
principle, and they met with
stunning success. (For
example, in Munich the death
rate from infection after
surgery dropped from 80 per
cent to almost zero.) By
1875, Joseph was receiving
international acclaim in
Europe. However, the
majority of English doctors
still misunderstood Joseph's
work and therefore failed to
accept its usefulness. It
was not until Joseph was
appointed Professor of
Surgery at King’s College
Hospital in London in 1877
that he began to win over
the English doctors. By
1879, Joseph Lister’s
principle of antiseptic
surgery had gained almost
universal acceptance.
Joseph went
on to develop new surgical
techniques by applying his
antiseptic principle. He
showed that suitably
sterilized materials could
be left inside the patient.
In 1877, he tied broken
bones together with
sterilized silver wire which
was left inside the patient.
‘Anyone trying to wire the
broken pieces together
without the antiseptic
technique would be faced
with an infected knee and
hospital gangrene.
Thus in 1880, he introduced
the use of sterilized catgut
for internal stitches, as
this would subsequently
dissolve (Previously, silk
thread used in internal
stitching was left hanging
out of the wound and was
pulled out later, often
causing further damage.).
Joseph also introduced the
use of rubber drainage tubes
after first using one on
Queen Victoria (For many
years he had been surgeon to
the Queen.).
In 1883,
Queen Victoria honored
Joseph by making him Sir
Joseph Lister. In 1897, he
was given the title Lord
Lister of Lyme Regis. He was
first to be made a British
peer for services to
medicine. In 1902, he was
given the Order of Merit,
and made a Privy Councilor.
In his later
years, Joseph was given many
prestigious positions by the
scientific community in
recognition of his great
contribution to medicine.
These included
Vice-President of the Royal
College of Surgeons,
President of the Royal
Society, and President of
the British Association for
the Advancement of Science.
In 1891, Joseph had helped
to establish the British
Institute of Preventative
Medicine. In 1903, this was
renamed the Lister Institute
in his honor.
Joseph died
on February 10, 1912, at
Walmer, Kent, England. He
had retired in 1893 after a
long and outstanding career.
Although the materials and
procedures used have changed
over the years, the
antiseptic principle itself
remains today as the
cornerstone of modern
surgery.

modern surgery, and all those that in some
way progressed science, the learning of
others, the publishing of new advancing
methods of medicine which improved our

Two months before the
2012 election this editor wrote an article
stating some people feel the race is fixed.
The litany of reasons was the JD demanding
an absence of identification for voters
allowing some to vote more then once as was
proven after the 2012 election through a
bragging poll worker who voted many times
for Barack, to large Real Estate Magnets
from the West, always strong Republican
Eagles for Reagan through Bush Jr., who were
not pleased by Mitt, but from what their
friends had said, it appeared that
Conservatives were being warned not to be
open about associations with Mitt Romney,
the Tea Party and other Conservative to
Centrist causes. Today, it became
clear that the second fear was true relative
to IRS-gate. Now add this to the
Benghazi cover-up to make it seem like
Barack had solved the Terrorist conundrum as
he stated, the election appeared fixed.
Clearly there is no scoop in this or
epiphany but folks are beginning to talk
like normal human beings. Some liberal
folks are beginning to talk about the
obvious issues which didn't seem important.
Whenever a single group or two, such as
Conservatives or Christians are being
injured, for some odd reason, it just took
the liberal media a while before humanity
superseded a total dedication to a man's
ideas who somehow hurt the press,
conservatives, Christians, and by the time
the smoke cleared, all folks on both sides
of the isle.
Well, folks of good
nature and proper upbringing although
knowing an elected official or someone is a
liar and negative for our world, move on in
life rather then stooping to the level of
that liar or having further involvement.
Liberals however call anyone who disagrees
with them, even if correct during this
cycle, a liar. The point is more
conservative folks often don't express such
things were it is often a pleasure for
others.
Well, all the good
folks may never catch on, but you can bet
dollars for donuts that al least my readers
will know, that if it feels like a pig, it
sounds like a pig, and smells like a pig, it
probably is a pig or very similar.
Something happened to this nation where many
of the good liberals have fallen into some
kind of a trap leaving their colleagues for
a better America, the Republicans and
Centrists in a lurch no Democrat has ever
been in. And it should never be
reversed as it appears much of the way the
Republicans were treated during this cycle
was do to revenge for things often unclear
to those who have developed the habit of
going over the top in any discussion, any
negotiations, and TV appearances and too
much more.
Leaders are elected to lead. Part
of leadership is making sure new types of
problems do not arise. If they do and
our leaders tell you they didn't know
anything about this stuff, their not
leaders, not even managers, but just elected
failures for the job elected for. Then
cover-ups, lies, or actions which caused
injury to civilians, are crimes against the
American people; crimes against all
Americans on any side of the isle.
Unless this congress
and our press can take America back, as this
editor predicted (All
events were predictable by the road were
on...it was as if the left was on LSD or
something seeing flowers everywhere while
the rest of the world smelled the smoke from
the fire burning under America)
would occur, it won't matter about Barack,
Hillary and others, as things will get
worse. Yes Barack unleashed a monster
government because he never understood
American History or what our forefathers
were escaping from in Europe. So he
created the founding of what old Europe was
all about. And this massive monster
could easily be taken advantage of by any of
the elected officials to follow Barack.
Why it could be an Egypt against its past
leader or much much more.
There is much wrong
and yet today, was the first Yankee Doodle
type day we have had in this nation for a
long time, hope sprang forth again.
Let us hope the Congress doesn't listen to
any words coming from the defendants to
scare them off the road to truth, and only
asks questions of our witnesses, and demand
answers to all the questions which are now
dragging this nation down. Election
fixing or are folks just too blind or just
not smart enough to see how things look to
the wise. Now if Election fixing was
the behind the scenes secret, that would
explain all the lies to the press, the
supporters, the those on the other side of
the isle and to the world. We sent a
lie around the globe in a video of Hillary
telling everyone the Benghazi murders were
do to a You Tube Video and that they would
get justice against the producer.
Today, innocents on both sides of the isle
and all corners of the American fabric were
indeed lied to. And the questions are
why, who lied about any of the issues, who
was the dope who made the new military
doctrine of we will leave our folks behind
as long as the elected folks are safe, and
finally what are we going to do with elected
or appointed officials who break the law?
Thus this article support Speaker Boehner
when he say's someone is going to jail.
Once the true perpetrator from each problem
is isolated, which is why special
prosecutors would be ideal, and especially
IRS-Gate, ONLY THEN IN TIME will the
persecuted again be fully comfortable.
Just think about post traumatic stress
syndrome from a government attack because
someone was a Democrat or Republican!
Or from folks in the military in fear over a
period of time in some remote outpost of
America under attack, that they may be left
behind!
The other day a Fox
Contributor was explaining everything goes
for folks running for office; THEIR ONLY JOB
IS to be elected no matter what. But
he was wrong. There are rules and
limits and breaking the law, persecuting
potential supporters of the other side,
allowing a system where folks may vote more
then once absent a any check and balance
system are outside the bounds and criminal
in that this act injured all
Americans, and our election system.
These are the types of questions which must
be answered so folks can go to sleep at
night knowing their furniture will still be
their in the morning.

This editor doubts
that many have read the White House Blog.
In the past when there was simply all bad
Barack Obama news, this editor would search
out White House.gov and find something
kindly that this editor could write about
Barack. Remember, this editor
supported him when he was a Senator, but
honestly, with the Benghazi cover-up day one
which made no sense, due to said
inconsistencies this editor also was perhaps
the first to put together the timeline as it
is known today, it is hard to believe
anything absent evidence along with the
words.
This editor even
remembers Fox News being let into an alleged
scoop but was again poppycock which this
editor wrote about and went single minded to
tell folks how this editor on 9/13/12 knew
it was a terrorist attack
(This
editor was consistent from day one or
9/11/2012; single minded if you will).
And the curiosity of what was being said
which was completely opposite at times to
what folks on the ground had said, and just
fantasy caused further scrutiny and
curiosity. Finally having lost my
mother last year, corresponding with Barack
about his loses relative to his mother and
grandmother's illness back in the day,
shocked the be Jesus out of me when this
editor heard Mrs. Smith's almost
breathtaking account of how Hillary Clinton,
Panetta and our President spoke to her.
And the liberal media/press was on the side
of "all that is wrongheaded" as it turns
out.
Yet
today, with Benghazi beginning to show a tad
of light down the long tunnel of deceit,
with IRS-Gate, AP-Gate, Text message-Gate,
Benghazi-Gate, apparently a US spy being
caught while we are trying to make overtures
to Putin about working together to end the
conflict in Syria, a tact which this editor
agreed with rather then any rush to war, or
rush to arm folks who may start another cold
war
(Nuclear Weapons Build Up etc),
it appears the perfect time to try to find
something positive to write about Barack.
Lets face it, this editor never remembers so
many different concomitant messes caused by
any President, his cabinet members or
appointees. Of course Jimmy Carter is
next, but four known debacles at one time?
That has to be a record. Remember when
the American Civil Liberties Union folks
received their
15 page completely blacked out response from
the Justice Department
(ACLU
filed a Freedom of Information Act request)
on Barack's warrantless government snooping
on citizen text messaging, this caused some
of Barack's major liberal backers in both
elections to go into silence. This
silence only means they are probably licking
their wounds for being mislead down the
primrose path, and may begin a Text
message-gate any day now
(Which
would be number four). It could
be just a matter of time. And you can
bet dollars for donuts that if the ACLU
finds a tip of the ice berg event, they will
be searching for other violations of your
civil liberties.
Well, this editor is
sorry to say, I don't want to make a fool
out of myself and buy into anything which
may be akin to Mrs. Smith's experience, and
thus this editor is placing a link to the

HEMOC CORNER
A 32 year old male
worker is raking grass when he notices a
small spasm in his neck. He goes to a
Doctor. Upon examination of the 32
year old the Doctor finds a non-tender
cervical lymph node 7.2 cm in diameter.
A simple biopsy of the lymph node would
show?
Follicular lymphoma
which is the most common indolent
non-Hodgkin lymphoma in adults, derived from
B cells. Like a spasm or sprain
case the disease has an indolent course of
remission and recurrences. The
patient is diagnosed with Follicular small
cleaved cell lymphoma.

Introduction
Certain laws cover most
employees today who are injured while in the
course of their employment. Injured
railroad employees are covered and protect
by a Federal Law, entitle the Federal
Employees Liability Act, also known as FELA.
The Jones Act is the only other federal law
and it covers maritime workers. Most
other workers are covered for injuries,
which they incur during the course of their
normal and customary work duties, by State
Compensation laws, especially in California.
This is a "no-fault" system covering
injuries, which arose out of employment or
during the course of employment (AOE/COE).
Furthermore, under the
auspices of FELA, there is no formula to
calculate monetary compensation or to define
for a jury what the limit is in terms of the
value that may be award for injuries.
Because of these pitfalls, many injured
workers have found that they can wreak a
goldmine from the courts for work-related
injuries. This is not to say that
there are not many injuries which indeed
deserve heavy compensation relative to the
losses which have been incurred by workers,
but it is to say that many workers have
found it all too easy to exploit the system
and bring home the gold, even thought they
are still clearly able to work and the
injuries that they have incurred are
minimal.
The next section focuses
on injury cases involving the railroad.
Approximately 90% of the cases handled by
the railroad actually involve railroad
workers themselves. Other cases
involve civilian bystanders who are
incidental to the injury-causing accidents.
FELA: FEDERAL EMPLOYEES LIABILITY ACT
The following cases do
not all involve railroad workers but many
do. Of the current railroad inventory
of cases some 90 to 95% involve injures to
their own employees with a portion relative
to civilians. These employee cases
reflect judgments and settlements involving
the Federal Employees Liability act (FELA).
There are two critical
addenda to the FELA, which are known as the
Boiler Inspection Act & the Safety Appliance
Act.
The Boiler Inspection
Act covers ladders, handholds, brakes,
safety appliances, lighting and the
cleanliness of the locomotive engine. The
Safety Appliance Act covers sill steps,
ladders, handholds, brakes, and other safety
appliance and coupling mechanisms, and all
other safety appliances on railroad cars.
If there is a violation of either one of
these acts a judge in a courtroom would
instruct the jury to consider the railroad
100% negligent and the only decision for the
jury is how much monetary damage to award.
The only defense the railroad has is to
prove the plaintiff is faking or is involved
in a fraudulent claim if one of these acts
applies.
CASES AND INCIDENTS
THE
PEAR SHAPED PARKING METER COLLECTOR
A 34 year old parking meter collector was
on his job on the streets of downtown Los
Angeles. He would open the parking
meters with a special key and collect the
coins that were inside as part of the
requirements of his job for the city.
He was a huge man being about 5'9" in height
and weighing in excess of 300 lbs.
Most of his weight was in his lower body and
he had a very large derriere.
He was opening a meter in a vacant
parking space and was bent over with his
rear end extending well past the curb line.
A railroad signal truck was backing into the
parking space, which was set up for parallel
parking. The driver did not see the
collector nor his large rear end, and as he
backed into the parking space his right rear
fender bumped the large derriere.
Pearshape told the driver that he should
have been more careful but he was not hurt,
and the driver made no report.
About six months later the railroad was
served with a lawsuit and Pearshape alleged
he had suffered numerous injuries. The
case started trial in the Los Angeles
Superior Court. The railroad defense
attorney did a masterful job in his
cross-examination of Pearshape. He had
him get out of the witness chair and stand
in front of the jury and then asked him to
recreate the position that he was in at the
time of the accident. Pearshape bent
over with his derriere pointed directly at
the jury. The defense attorney slowly
had min move closer and closer to the jurors
until his derriere was almost directly in
their faces. You could visualize the
defense attorney having him move his
derriere closer, closer still, and have him
move it around just as he had the day of the
alleged incident. I could see grins on
several of the jurors' faces as this case
was turning into a comedy.
The jury was out about thirty minutes for
their deliberations and returned with a
defense verdict. This was one of the
most humorous trials I had ever observed
exemplified by the clever manipulations of
the defense attorney.

THE
GOLDEN GATE
A 44 year old conductor was working on a
switching crew that delivered cars to the
Chevron Oil Refinery in El Segundo,
California. There was a locked gat
across the tracks, and all of the railroad
crews had keys to open this gate for access
into the refinery. The railroad had
previously reported trouble with the gate to
Chevron who was responsible for maintaining
it. The gate had come off of the
rollers and had to be physically dragged to
open or shut it.
The conductor was attempting to open the
gate and was pulling very hard on it,
dragging it across the black top when it
suddenly dropped further from the rollers
and caused him to fall and twist his back.
His injury was a herniated disk in the low
back and he underwent surgery. He
retained n attorney and sued both the
railroad and Chevron. The railroad
paid a small amount to settle and a large
amount was paid in settlement by Chevron,
who had the real responsibility for the
gate.
The conductor was very pleased with his
settlement. I happened to run into him
in a railroad yard about 2 years after the
settlement. He told me that he drove
by this gate every day on his way to work
and he had named it his
"Golden Gate"relative
to his six-figure settlement from Chevron.

CONDOLENCES FOR THE OKLAHOMA
TORNADO DEAD AND BEST WISHES FOR THE LIVING
The American Academy
for Justice Through Science members wish our
condolences for the horrific losses of all
the precious life from children to
grand folks, lost this week due to massive
Tornados in Oklahoma. This editor
wishes the best and my support to help folks
rebuild better, and ask this balloted
government to do some research on how to
extinguish if you may, a Tornado. Even
this editor has some ideas but that is left
for a forum of folks who could make things
happen; such as a particular device system
employed and manpower. Further
we must have a faster FEMA response then
what has been witnessed to date.
This editor wishes my
deep felt condolences for any losses in any
of the states affected by last week and this
weeks massive Tornados. Let us all
pray that our parades no longer get rained
upon, and that we can have good luck and
good efforts in rebuilding all that has been
lost, to even newer and stronger standards.
This will take money from the government and
swift action is needed. Condolences
for our dead and best wishes for our living,
and may the lord continue to bless America.

has ever witnessed relative to the lack of
health or freedom for American Citizens and
out and out lies coming from our elected

Furious-Gate to spying on your text messages
absent a warrant to a redefining of words so

world, Barack Obama, would not blame his
failures and his appointees failures on

nation the bad news on 9/11/2012?
Somehow they really outsmarted themselves

that out of context to make his point, all

(We have to wait to see what happened; it
already happened; you were supposed to be on
top of things having predicted it would

happenings/mistakes...and then after we wait
over and over again they say "too much time
passed so its old news),
well, looked almost evil. Jodi Arias,
Castro, spying on the leading source for
news for the rest of the press with a broad
brush, in fact THE LARGEST NET EVER
UNLEASHED and for the far less sensitive
materials than have been leaked out of our
White House. The law would opine a pin
point precision investigation not finding
out all sources for all reporters, editors
and so forth of the AP. The real news
these day's has been horrible. Boston
Massacre Bombings which should not have
occurred under this watch, Fast and Furious
selling any kind of weapon to the Criminals
while at the same time trying to keep guns
out of the hands of the citizens who must
defend themselves when no one else is around
and now multiple scandals as a result of our
leadership! If there was ever a
problem Obama blamed it on Bush. But
now that too many problems occurred under
Obama suddenly its rationalization after
rationalization, blaming innocents and often
filled with lies on top of lies on top of
more lies.
Is this administrating
telling us that absent a J. Edgar Hoover in
the Directors office, renegades can hijack
various offices of our agencies, our
Congress, Supreme Court and White House and
attack the parts of the American people it
feels are political adversaries? That
is the truth of the Obama years? What
is the truth? No one knows what is
going on with our Government which has
become a bloated overgrown behemoth monster,
with thousands of talking heads, thousands
of arms and tentacles sucking the life out
of freedom, and millions of legs trampling
all the assurances set into place by the
founding fathers and Bill of Rights to
protect the innocents from even the
slightest abuse by our government.
This is why the founding fathers lectured us

Our government was to send love, truth,
understanding and closure to Mrs. Smith but
those promises of hope have left her in a
deeper despair! She lost her son and
discovered a cold heartless government.

When in the course of
American citizen events, when the powers
hinder the province of the good citizen, to
the extent that by political grounds and not
even humanistic grounds, our government
interferes with the freedoms guaranteed
under our Constitution and Bill of Rights,
our people have the right to challenge their
elected officials, and not have to fear
retribution because the citizen isn't super
rich, backed by a radio station, a TV
station, a network, a political party, a
union and so forth. This nation must
not be run by the people with power as it is
becoming. No we must march back time,
and reinstitution protections against all
attacks, and fortify the protections each
and every citizen was born with as a free
American Citizen. Out with the Obama
mentality and in with Common Sense.

American Revolution.
It is time to demand
our nation back, but with the soft words of
the finest spokespersons, so as to lay the

the grieving mother for her hero son dyeing

ACTUAL CASES FROM "TALES OF THE RAILSRAILROAD
CLAIMS STORIES" BY NORMAN UDEWITZ- A NEW
INFOJUSTICE JOURNAL SERIES WEEK TEN
CASES AND INCIDENTS
THE
JAILBIRD CONDUCTOR
This case involved a
48 year old conductor who worked in the
desert town of El Centro, California near
the Mexican border. He was riding in a
caboose of a train when the engineer had to
apply the brakes to avoid striking a vehicle
at a railroad crossing. The resulting
slack action
(each car from the
rear striking the car in front like a domino
effect)
caused the conductor to be thrown forward to
the floor, causing injury to the hand,
wrist, and shoulder.
Prior to the time of
the injury the conductor had been ordered by
the court to make monthly child support
payments, as he was divorced. After
the injury he went across the Mexican border
to live in Mexicali. He had his
government disability checks sent there and
ceased making the child support payments.
When he returned to work his ex-wife had him
arrested by a Marshall who came onto the
locomotive and handcuffed him.
I arrived in El Centro
a few days later unaware of the arrest.
One of the clerks at the station stated the
conductor had to see me right away. I
told the clerk that was fine and I would go
by his house, as an attorney did not
represent him.
I was then advised
that he was in jail and arrangements were
made for me to visit him there, which I did.
I will never forget the cold metallic clang
as the cell door was closed and locked
behind me and I was left within the cell
with the conductor. He then advised me
he had been in jail six days and had to get
out. He suggested that I had to make a
settlement with him to include the child
support monies, which were in arrears.
He further advised that if I did not settle
with him right then and there he would have
to retain an attorney to get out of jail.
The only way he could do this is to give the
attorney the injury case on contingency, as
he had no money to pay him.
It was my habit to
carry releases and blank settlement drafts
when I worked away from the home office.
We agreed on a settlement and I hand wrote
out a release and settlement check. I
was greatly relieved when I left the jail,
and the cell door clanged behind me for the
last time.

SURVEILLANCE
Surveillance is one of
the greatest tools to the injury defense in
railroad cases and often leads to many
humorous incidents. The plaintiff
attorney never knows what the defense gets
on the plaintiff until they view the film.
In deposition the plaintiff will usually
admit to many more activities than the
defense has on film. The film is not
always shown to a jury, as the revealing of
it to the plaintiff often forces an
extremely reasonable settlement.
Under the law the
defense is not required to give the
plaintiff the film until he has testified
under oath in a deposition and described
what his activities and limitations are.
When the plaintiff learns the defense has
surveillance film of his activity it is like
dropping a bomb onto the middle of the case
and he will sing like a canary as to many
activities the defense does not have on film
or even is aware of. At times, illicit
and even criminal activities are observed
and filmed by the surveillance operative.
In addition, some observations that prove
very embarrassing to the plaintiff can be
made.
COCAINE COWBOY
This case involves a
32-year old railroad machinist who alleged
he had a back sprain. He claimed he was
working on the maintenance of a locomotive
engine and twisted his back while he was
trying to turn a bolt with a wrench.
We were highly suspicious of this
individual, and he had been one of the
suspects in the Skid Row Slasher Case.
He retained an attorney who placed us on
notice with a letter of representation.
I immediately placed
surveillance on the machinist. The
first day they obtained film of him pushing
a flat bed truck down the street. More
importantly, he later was followed into an
intersection in downtown Los Angeles, and
film was obtained showing him walking over
to a vehicle that had pulled to the curb and
exchanging a package of an unknown substance
for money. This film was shown to the
plaintiff attorney whose comment was, "I
want out of this case."
The matter was settled
very cheaply and the individual did not come
back to work for the railroad.

Dear Little Guy,
When Hillary Clinton said "What does it
matter" in the original Benghazi hearing, I
wanted to kick her in the teeth. I can
only hope that some of this is remembered 3
years from now when she enters into the
presidential election. From her
actions and of course not her words or
anyone's words from this administration, I
am all for putting the blame where it should
be.

This editor thanks you for responding to

withheld your name because it is clear that
we are not a free nation. Folks for
some years now are afraid of retribution for
what was once "freedom of speech".
Folks are afraid to write, blog or tweet
about what they observe, and clearly our
Government is now known for retributions
against its citizens based on political
beliefs, AROUND THE GLOBE. Very much
like NAZI Germany save this time the only
winners over and over again are Terrorists.
I understand how someone like yourself who
served this nation in harms way as a Navy
Vet, as well as many other Veterans feel,
our nation will run out on you if it is
expedient for some tangential political
gain. Even this morning the only one

into my eyes" before he lied or bit victoms.
When I was young, my
father and I went Deer hunting with some men
in Northern Minnesota. It is grand fun
camping out, practicing shooting, and
everything including the hunt. The
snow was deep, it was snowing lightly but
with big beautify flakes which seemed to
float as they meandered downward, and the
men let me take a shot. Everything was
perfect from our camouflage to our
camouflaged position. After the Deer
was killed upon examination of the animal,
your editor as a young lad advised my
wonderful father that the Deer's eyes were
so beautiful. I didn't feel right
about stuff. My father looked into the
Deer's eyes, and agreed. It was grand
having my father agree with me, we bid the
other hunters ado, and returned to St. Paul
absent the Deer who the other hunters
empathically wanted for its meat. The
point! I can't look into another human
being's eyes and lie to them. When I
adjust patients often

specific posture they look me in the eyes as
they don't know what's going on.
And when I deliver my adjustment, they are
reassured by my eye contact that they are in
the best trained and over educated hands

and undeservingly so visa vie such horrific

besmirching a Hero's cause of death to his

and sent into harms way absent normal and
customary protections. Even the
emergency scramble team was called off.
Who ordered help to stand down?
Everything was a failure from the protection
of our Ambassador and the heroes who tried
to save the day, a failure in sending in
help or protection even for the remaining
folks on the ground, and then a failure to
simply tell us what happened. But then
three days later, to promise Mrs. Smith the
cause of her son's death was a phony baloney
story, and that the heinous perpetrators
would be brought to justice by now, was
painful to all good folks and simply
unacceptable. As it turns out the
actions taken by our government hindered
forensic terrorist investigations.
If you ever loved this
nation and what it has stood for, what our
flag stands for, or believe in good over
evil, you will have to take a stand and tell
others to pay attention. For our
nation will never overcome the evil in our
world by leading through evil. They
knew they were lying when they looked into
the eyes of a distraught and bereaving
mother, when they told the video lie to "we
the people, as well as sending a fictitious
lie filled video around the globe at
taxpayers expense. Believe it and live
freely in the greatest civilian nation in
mankind's experiential existence or live in
a fantasy world doomed to be nuked by
terrorists someday. It is all truly up
to "you" American people. Let us make
sure none of this ever happens again by
continuing the search for truth relative to
the Benghazi horrors.

ADAM AND THE LOVE IN
FOR A WONDERFUL FRIDAY
Well folks, its another Friday night, the holly of
holly's for the Jewish people relative to daily worship
(Not High Holliday's)
and it occurred to this examiner that most folks don't know why, the
Sabbath begins on Friday and the day of rest is Saturday (And because
Jewish folks are Jewish, they get Sunday off to).
Friday was the birthday of
Eve. Thus, Friday evening is the Jewish celebration of
the female sprit coming into the world. When Jewish folks look at
Religion, often they don't say Gay or Lesbian is bad, they say "its
nobodies business". But if you were to ask what is assumed about
religion they might opine "G-d thought marriage was between Adam and
Eve. If G-d wanted gay's or lesbians to be what's natural the
story of Adam and Eve would have been Adam and the Love In, or some such
story...maybe Eve's Eve's. But creation and evolution are based on
the outcome of births after the parent and their parents and their
parents went through environmental and situational factors which guild
evolution to insure survival of the species. For example when I
was young this editor must opine the different races looked much
different. But today, most cute folks from any color, creed, or
race look similar and folks are looking more similar through out the
continuum from the various races as we evolve.
In any event, husbands and boyfriends, tell your
wife, girl friend, mother or loved one "I love you" on your Friday
nights, as Americans we all become similar in this great unifying
melting pot, this great United States of America. And on Friday's
when you are alone with your loved one or have a moment, tell them
you love
them
and join the Jewish people's tradition and celebrate every Friday
evening from now on, as

Well, this editor now see's why this
nation is wayward compared to just 6 years
ago. We lost our money 6 years ago but
were stalwart! Today this nation is
run horrifically, and listening to the House
Democrats spin on every attempt they had to
question folks, is a horrific indictment of
our nation. What does this teach our
children about the truth. And from
this what behaviors could you prognosticate
we would observe in such youths?
Everything Obama used to apologize for
was done by our Democrats in the House
today. They put words in the poor
witnesses mouths
(Haven't those folks suffered enough for the
eternals sake?), but the witnesses
were too good of folks to fall for any of
the bait albeit said foolish interruptions
by the questioners stopped the witnesses
from telling their story. And to then
ask them if some alleged big shot was a liar
because what they falsely testified to was
being quoted again was a wrongful method of
questing. Horrible folks, just
horrible.
From Clinton to Dempsey and on down the
line, everything appears to have been a
fictitious creation of theirs and presented
to the American people just as this editor
wrote the very day of 9/11 because of
information that was easily gathered but
then as the day's moved on disappeared from
key international Internet sources.
Everything presented by our Government
relative to Benghazi was spin, and absent
naming names again, there was zero in the
way of internal controls in place to protect
our Libyan Ambassador as if to invite the
attacks or if nothing else then complete and
utter incompetence. Then the day of
9/11 there was zero in the way of giving the
all American try as would have occurred by
Bush for example. Nothing was done to
help our lost loved ones in Benghazi, and it
appears that the affirmation taken to bring
the truth to the American people through
thick and thin was broken by everyone?
Everyone? Well there needs to be more
hearings but at least up to the level of
Clinton thus far we have discovered a spin
operation to create folks, create a false
narrative about a stupid video. All
three time lines, prior to the 9/11 attacks,
during the 9/11 attacks, and after the 9/11
attacks demonstrate propaganda and
violations of the public trust.
What is not clear or admitted yet is why?
And what is worse is that being a witness to
such scandalous questioning by the House
Democrats, and the fact that Democrats of
this ilk outnumber the total number of
Republicans, bodes poorly for any justice in
these matters, and points to a future filled
with more half truths, mistruths, out and
out lies given to the American people and
perhaps at times, the manner in which the
American people, "we the people" will be
treated in one matter or another.
Much much more will come out of these
hearings but for now, albeit everything
reported here at the Journal those first
four weeks post 9/11/12 was correct.
But what is not correct and we do know is
that Democrats in the House today, rather
then asking question and listening for the
answers, read from other either cover-up
coconspirators or investigators opinions
based on incorrect information. This
is a horrible embarrassment for any thinking
Democrat. It shouldn't matter ones
party, today's Democrats were an
embarrassment to all thinking Americans.
Let us pray that we get to the bottom of
things, and once finished focus on creating
jobs. For absent jobs, our citizens
are too weak to defend themselves in life
against evil, food shortages, paying for the
basic requirements of rent, insurance, or
basic sustenance. But in any event
this 8th day in May, historically has proven
a dark day for our great Republic and to the
grand symbols such as our flag which
represent us all. May the lord
continue to Bless America and perhaps put a
toe in to help us all and save us from
ourselves as the Democrats proved today; we
need to be saved from ourselves outside of
the Terrorists.little

ACTUAL CASES FROM "TALES OF THE

OTHER INTERESTING AND HUMOROUS CASES AND
INCIDENTS
THE
TRAIN FROM HELL
There is a federal law, which applies to
railroad workers and are involved in moving
trains called the "Hours of Work Act" and
basically allows a railroad worker to be on
the job no more than 12 hours. He must
then be given an 8-hour period of rest
before he can again work on a train.
When a railroad worker or train crew
completes 12 hours of work it is called
"Going Dead on the Law". A new crew
being brought out to replace the crew that
is out of time is called a "Patch Crew".
All trains operate on an airbrake system
in which an airline runs from the lead
locomotive to the end of the train.
This system is used for brake applications
to slow down the train and the air forces
the pistons out onto the wheels. The
rule on the Southern Pacific was the train
must have 90 lbs per square inch of air
pressure before the train can be moved.
The engineer can make a service brake
application, which is a routine method of
slowing down the train. If an
obstruction appears ahead of him on the
tracks he can make an emergency application
of air, which is a quicker way to stop the
train. However, if he is moving at a
higher rate of speed and has a lot of weight
in the train, even an emergency application
of the airbrake will not immediately stop
the train.
Sometimes when the engineer applies the
service brake, or the routine airbrake, an
undesired emergency brake action will occur,
and this is called a U.D.E. Following
a U.D.E the conductor or brakeman must walk
the train to determine why it went into
emergency braking. A U.D.E. can
occur even when there is no application of
airbrakes by the engineer.
A 51 year old conductor was brought out
to relieve or patch a train crew at Corona,
New Mexico. This is an area between
Tucumcari, New Mexico and El Paso, Texas and
is down grade with many curves through a
desert mountainous region. The train
consisted of several engine units and
approximately 100 cars. They started
moving and after about two miles a U.D.E.
occurred.
The conductor walked to the train and
found a dragging air hose. His walk
was on a dirt path, which curved and was
home to a number of rattlesnakes. He
had to avoid several of these serpents
during his walking of the train, which
placed him in a state of agitation and fear.
He found an air hose which had been dragging
and wired it back up and then had to make
his way back to the locomotive. All of
this took about 2 hours. The engineer
pumped the air brake system back up to 90
P.S.I. and the train then proceeded on its
journey down hill.
After about 10 miles another U.D.E.
occurred and he again had to walk the train
in a rattlesnake infested area and wire up
another dragging air hose. Again he
walked back to the locomotive, the air was
pumped up, and they continued on their
journey. This time they got about
three miles and another U.D.E. occurred.
He walked again to about mid-way of the
train and found that one of the knuckles
between cars was broken and the air hoses
had parted, thereby causing the emergency
stop. He radioed the dispatcher and
told him he would need help, and the
dispatcher replied that there was none.
He then had to go back to the locomotive and
get a knuckle, which is cast iron and
weights about 60 lbs and carry it back to
the car with the damaged knuckle. He
replaced the damaged knuckle with the new
one and radioed the engineer to pull ahead a
small distance and stretch the train.
That was done but unfortunately the knuckle
did not work and the air hoses came apart.
There was only one more knuckle on the
locomotive and he went back to get it.
By this time 5 or 6 hours more had passed
and a Signal Maintainer, who was in the area
with his pickup overheard the conversation
on the radio and advised he would help.
He drove over to the locomotive and they got
the remaining knuckle and started back to
the middle part of the train. There is
no road along the tracks in this area and
the road curves around and goes through
several ranchers' gates before they could
get back to the involved knuckle.
Again, the new knuckle was placed on but it
did not work either.
At this time the conductor radioed the
dispatcher and advised him of his problems
and it was getting dark and that he was
going to be Dead on the Law in a short time.
The dispatcher told him to cut the car out
on a sidetrack, which was in the area, and
leave it. This took several switching
moves and antler long period of time.
He was able to remove a knuckle from the
opposite end of the car and use it to
replace the damaged one and put the train
back together. The signal maintainer
had to leave with the truck as he was low on
gas and the conductor started walking back
to the head end. By this time it was
dark and he was using a flash light to light
his way and look for rattlesnakes.
His back was hurting from carrying the
knuckles up and down hills and sliding in
the sand. He sat down to rest by a
bush for a moment, after making sure there
were no rattlesnakes under it. Shortly
after he sat down a stealth bomber from a
nearby air base buzzed him and this caused
further anxiety. When he finally got
back to the engine, the dispatcher advised
him to take the train to the next siding and
a taxi would pick them up as he and the
engineer were going Dead on the Law.
This was done and he returned to El Paso in
the taxi.
The next day his back was hurting
severely and he went to an orthopedic
surgeon. He ultimately had a back
surgery and retained an attorney. The
case was settled with the attorney and as a
part of the deal he resigned from the
railroad. This was truly a train from
hell.

Has anybody ever played the computer game
Spades, where you can't communicate with
your team mate but you have to make sure
they win so you win. If not, each hand
your score decreases. If you have
played that game look at Syria. The
civil war essentially places Russia, Iran
and Syria on one side, and its freedom
wanting peoples, al-Qaeda, Hamas, and all
the rest of the terrorist groups on the
other side. Now think about spades.
If the US could win meaning freedom and
democracy is ensured concomitantly securing
any WMD's/Chemical Weapons as well as Russia
meaning they get to keep their warm water
naval Syrian port, we could turn things
around in short order. The downside of
giving arms to the wrong folks in Syria, and
face it our government cant even pick the
winning business group to give taxpayers
dollars to let alone folks lying claiming to
be freedom fighters but actually are
al-Qaeda or al-Qaeda light. Further
once armed they may be fighting against
Russian soldiers on the ground. The
war could turn into a World War if were not
careful.
However with a little help from our
friends such as Israel, we could take out
the Iranian Nuclear projects immediately
talking Iran out of the fight in Syria.
Let Israel help us detect who is who in
their neighbors back yard, and either cut a
deal with Russia to stabilize Syria so they
get their long term investment to come to
fruition, but that upon stabilization the
Syrian President must step down. We
can rely on little Israel to continue to do
the right thing, but if we are not careful,
and it appears form listening to the
honorable John McCain today, that he was
calm and correct on everything but Russia.
The last thing we need is to start another
COLD WAR! Perhaps there is still hard
feelings from the past, but in any event
McCain demonstrated some good old American
maturation on this issue. This editor
would opine Mc Cain called for intervention
early when it would have been possible.
But everyone knows even if they don't want
to enter it into the equation, that much in
the way of terrorist forces has infiltrated
Syrian rebels on the ground and our best
guess if ARMING FIGHTERS THAT MAY BE
UNDERCOVER TERRORISTS would in this editors
opinion, guarantee another fallen state
ending up in the hands of the Terrorists.
(1). Take out Iran's nuclear
threats now and show the world we mean
business on such earth changing matters as
control over nuclear destruction
(In the hands of Terrorists in Iran who
would sell it to Hamas etc-No nuclear
bombings in Boston or New York etc!),
and take Iran out of the Syrian equation.
(2). Since Russia is on the ground
in Syria, has a vested interest long held
(60 years now)
in Russia for a Warm Water Naval Base
which they already have set up in Syria, to
become partners with the US/Western
Societies by bringing full stabilization to
Syria with a government moving toward that
which would be by the people, for the people
and of the people. Of course Russia
gets to keep its base just as the US was
allowed to keep ours in German and around
the globe. No one has to arm anyone,
and Russia puts their boots on the ground
(They are already
there!)
to end the fighting and weed out
terrorists.
(3). Let the Syrian president know
that he must retire and perhaps be allowed
to live in Russia or some such place, but
put in place a democratic government which
would certainly go along way toward
improving his standing. Lets face it,
McCain has seen too much war horrors, and
his motivations are from his heart on this
one. And folks 70,000 dead albeit more
and more near the last six months have been
of the terrorist ilk. Thus the US/Free
peoples achieve a roundup of all chemical
and other WMD's ensuring zero chance of a
terrorist or Islamic Jihadist WMD armed
nation, rather one which would be on a road
to democracy and one for the people, by the
people and of the Syrian people.
Clearly such a professional plan may be
to simple which would guarantee success, and
the power brokers around the globe,
including these American Progressives, may
have to use their broad strokes which
resulted in today's unstable Libya and more
so Egypt. Somehow we need to turn this
lemon into lemonade rather then make such a
war mess out of everything with massive
destruction, that it becomes impossible for
civilized folks who reside in Syria to
overcome the murderous and threatening
Terrorist infiltrators.
Finally this plan removes Iran and its
secret Henchmen from the picture while their
committing to join the world community
rather then build nuclear Wimp's, puts
Russia on our side removing any adversarial
hindrances, stabilizes Syria, and removes
its President without spending one US dollar
on Syria. Remember the track record
shows we have armed the wrong folks in Libya
and Egypt, left no base in Iraq who is
leaning toward Iranian influence simply out
of fear, for all intent and purposes left
Afghanistan ripe for the picking once we
leave, and made little in the way of closer
alliances between the US and Pakistan.
My plan begins a new friendship between the
East and the West based on democratic
principles and capitalism vs.
Terrorism/Communism/socialism.

On the positive side we have Israeli
intelligence and some Syrian innocents on
our side. On the negative side there
is al-Qaeda, al-Qaeda light, Hamas, Iran,
Russia and a war torn, tormented Syrian
President whose decision making has been

entire middle east and north Africa into
al-Qaeda and Terrorist Islamic Jihad

VATO
A Vato is a Mexican
gang member commonly seen on the streets of
Los Angeles and other large cities and
dressed in floppy pants and shirts.
They usually have a crew type haircut and
are heavily tattooed.
A 27 year old Mexican
American track laborer was working with the
gang on track repairs at Santa Fe Springs,
California. He and a co-worker were
carrying old wooden railroad ties down an
incline to get them out of the way so that
new ties could be inserted. As they
were walking down the hill the co-worker
slipped and dropped his end of the tie.
This caused the laborer to become unbalanced
and twist his back as he attempted to hold
the tie. He underwent a low back
surgery and retained an attorney and a
lawsuit was filed.
This case did not
settle and went to trial in the United
States District Court in Los Angeles.
During the trial, the injured laborer
appeared at court accompanied by his friend
who was a certified Vato, even though his
lawyers told him to keep the friend away
from the court. He ignored them and
the Vato was with him every day. The
Vato seemed to take no interest in the
proceedings and even fell asleep in the
courtroom and started snoring. The
jury observed all of this.
The jury returned a
defense verdict and the look on the
plaintiff's face was of pure amazement and
he loudly asked his attorneys, "What does
this mean?" They told him that he was
awarded no money. The railroad was
delighted with this verdict.
The plaintiff attorney
appealed based on an erroneous instruction
by the trial judge. Unfortunately the
appeals court granted a new trial in the
matter. At this point a settlement was
made, as the railroad did not want to
undergo another trial, particularly knowing
that Vato would not attend.
The railroad would
have gladly paid Vato's witness fees to
ensure his attendance at a new trial, so
that a new jury could observe him.
ONE BONUS FOR AVID JOURNAL READERS IS
REFERENCED BELOW:
MATAGORDA COUNTY, TEXAS
In Texas some of the
rural counties have a "good old boy system"
for electing judges. In Matagorda
County the judge must be in the favor of the
labor unions and the plaintiff attorneys in
order to be elected. Also in Texas
there is a law that provides that a person
claiming injury can sue a corporation that
he alleges is responsible for the injury in
any county in the state in which the
corporation does business.
Many railroad
employees injured in Texas were filing their
lawsuits in Matagorda County and receiving
large verdicts. I recall one example
that involved a non-operated back, in which
the employee returned to work and the
verdict was $800,000.
Because the railroad
could not continue to pay this type of
verdict, they had to pull up all their
tracks in the county and construct new
tracks around it. This finally ended
the Matagorda County cases, the railroad
tax, and other revenues to that county.
It was a drastic but sure solution to an
expanding problem.

CASES AND INCIDENTS
THE
LOVELORN POLICE WOMEN
This lady was hired as patrol person for
the railroad police department. She
worked for a Sergeant who she claimed called
her repeatedly at home and offered to get
her better and easier jobs in return for
sexual favors. She had tape-recorded
several of these conversations.
Lovelorn was well known among the
railroad police department for spreading her
favors among various officers. The
story was if you told her you loved her, you
could have intercourse with her. If
you did not tell her this you were only
favored with oral sex. In addition to
this she had alleged she had a slip and fall
injury to her back at the railroad offices.
When she complained to her supervisors
about sexual harassment by the Sergeant he
was confronted by them and admitted his
guilt. He wound up patrolling a beat
in Tucumcari, New Mexico. She then
retained a well-known feminist lawyer (You
would not believe who unless you were from
the Golden State) and brought a lawsuit
against the railroad.
Word got out that this lawyer was going
to bring members of the press corps with her
to the police headquarters when she served
the lawsuit complaint. The higher up
officers quickly abandoned the building
leaving only a patrolman minding the front
desk. The renowned feminist lawyer
burst through the doors with the TV cameras
rolling, only to find a young and bewildered
patrolman who had absolutely no idea of what
was going on.
During the course of the investigation I
learned of Lovelorn's many sexual
indiscretions. The first of two of the
most humorous tales involved the railroad
having a problem with thieves stealing
radios and tires from new automobiles being
transported on railroad cars.
She was sent to stake out these carts at
night with a male partner. Another
officer who happened to be passing by in a
patrol car observed a suspect breaking into
a new automobile on the first level of a
three level railcar and made an arrest.
When he reported in to headquarters he was
asked the whereabouts of the female officer
and her partner. When he advised he
did not know, he was sent back to check it
out. He found both of them happily
involved in love making in the back seat of
a new automobile on the 3rd level of the
railcar, completely oblivious to the
attempted break-in.
In the second situation she was sent out
to patrol an area of tunnels at Chatsworth,
California, which had a growth of brush.
Another male officer accompanied her.
The following morning both of them
reported in for medical care as a result of
poison ivy. She had a rash on her mouth and
he had a rash on his genitalia!
When her attorney was confronted with
this new evidence the case settled for a
song and a dance (very cheaply).

CARD PICK-UP
During the filming of the movie "52 Card
Pick-Up", one of the scenes called for an
automobile to blow up on a dock in the Los
Angeles Harbor with a mannequin seated in
the automobile. This was arranged and
the auto was left sitting on the dock
blocking a railroad track.
There was an agreement with the railroad
to do this but they forgot to notify the
switching crew. When the engine
arrived they found the automobile blocking
the railroad track. The conductor got
off the engine and walked over to the car
and was screaming at the mannequin, that he
thought was a person, to move the automobile
out of the way. When he got no
response he became even more frustrated.
Finally, one of the other crewmembers
recognized the mannequin for what it was.
They then radioed the yard office to report
the situation and were advised of the
filming and were told to leave the area.
This situation became known on the
railroad as one dummy talking to another.

WELL WERE NOT
TALKING
Folks, if you could read the email this
editor received, or if this editor wanted to
be part of today's joke of a media,
everything that happened since the Boston
Massacre would be audited for you.
Nothing reported by our folks in power was
the truth. For the first time in
history our government is akin to other
governments. Clearly once Russia let
us know that we may have a trouble maker in
Boston, and bombs went off, any real
forensic examiner would look at those folks
first, see their pictures and never need all
the hype that followed the Bombings.
Benghazi Boston all over again.
Well, this editor is simply trying to
help people and nothing else. Lets say
one is a Peace Officer, clearly one of the
most important people helping job on the
planet. Do you believe a Peace Officer
or even a licensed Medical Physician in one
day could help over 200 patients with their
treatments and examine 7 others? No.
It doesn't matter folks evil prejudice, the
lords truth is as a humble Chiropractic
Orthopedist, on the days I work, never are
less then 70 different souls helped.
And I only treat each patient once a week.
So as I travel to different offices, 70
here, 70 there
(Low now because we
have discharged so many folks although 70-80
folks per day is something the Lord most
high would be proud of), the point is
my life is dedicated and my actions prove
help for the sick, the suffering, often the
poor, the weak, the helpless, the
downtrodden, those on fixed income to
include all souls of every color, creed,
religion or race who have a manipuable
lesion which requires care, for over 31
years! Folks when I was in medical
school and matriculating through my
accredited Hospital Clinical Clerkships in
Medicine, MD's who had prejudice in the
past, witnessing folks recovering or
returning to health with my care above and
beyond what they were teaching me, brought a
family of physicians and surgeons into the
family of Chiropractic Medicine. The
Medical Amalgam is healing while all the
evil doers try to pry apart unified
medicine, just as they try to pry apart a
love for our Republic.
My actions prove a love for mankind, but
as this editor looks around, I must opine
sleaze is noted more then anytime in my
life. Look at the entire left which
has turned into one big Dog Whistle by
today's meaning of going out of its way to
bring racial prejudice and hatred back,
while many folks who were liberal under old
definitions, more and more, find themselves
centrists or conservative by today's
standards.
In any event, this time the Benghazi
Boston Massacre was not a nuclear weapon,
but it is clear as day why the Russians
don't feel safe in sending their children
here (We can't even secure our borders or
examine ethically those we take into our
nation). Folks, join with me won't
you, and lets bring home the ideas that ones
parents are better off with their loved ones
so they can die happy in the arms of Family
rather then hate their lives imprisoned in
institutions for the elderly that only care
as a matter of PR, but steal folks who live
there blind, never to be able to look daily
into the eyes of the Child who is willing to
care for them, and lets care for children
delivered from a women who would have rather
had an abortion, and not murder the child
now that it has been brought into a world
run by human beings. Greed, self
aggrandizing egregious, pontificating
behaviors are ruining our society and unless
the truth is recognized, our nation will
continue to de-evolve.
There is much to be learned by the Bible
even if one has a vacuum where others
spirits reside, for we must learn to treat
each other nobly, we must study the ideas
and ideals of the founding fathers, so that
we can again someday stand on the shoulders
of giants, rather then on the shoulders of
the owe so flawed leaders we have to date.
This is the worst time for our nation in my
lifetime, but with folks like this editor,
out daily helping the sick, and for very
little in the way of wages, proves there is
hope for this world.
Good luck my friends, and as has been
written here for over 17 years, may the lord
bless you (we the people of the United
States), and bless our great Republic, for
it is the hope for humanity.

BELIEVE IT OR NOT THIS TIME OBAMA IS CORRECT
Last week it was
perfectly clear that Saddam's weapons of
mass destruction were used. Basic
Saran gas is easy to detect. Yet
Saddam got away with it because his WMD's
were mixed to hide the easy detectability.
Saddam's finger print was found last week
while the liberal and conservative media
along with John McCain rush to judgment.
Folks, do you really want to rush into
another war? The mistake in Iraq was
not the WMD's as it is turning out, but
rushing into a situation that we knew little
about. Globally the Syrian or Iraqi
Tyrannies were easy to identify. But
the folks making up the fabric of the
nations were misunderstood. In other
words Iraq had several groups and
intervening by the end of the day, left
support for Iran, and even worse enemy.
Rushing into Syria may
lead to the elimination of al-Assad but
could lead to another rouge nation ripe for
the picking by al-Qaeda and its copy cats.
President Obama by not overreacting to his
red line, demonstrates a developing wisdom
he has never shown relative to world
affairs. He has unfortunately been the rush
to judgment President, almost always
governing by ideology rather then common
sense (Which more and
more folks feel has ruined Justice and its
decision making-i.e. the etiology of the
Boston Bombing Massacre of 2013).
Further the way he was treated as almost a
rebel himself on his issues as a community
activist, demonstrate much of the reasons
why almost half of the public no longer can
relate to him.
In any event absent
trying to understand Barack's entire make
up, what this editor see's is a President
who is not rushing us into something which
further kills off our children
(Men and Women of our armed forces)
for folks who just as in Afghanistan, will
find ways to shoot us in the back.
One opinion is to
eventually unleash some of our other weapons
onto a battle field if ever brought into a
War conflict again. For example we can
now light fight a plane or missile out of
the sky. Yet used on the battle field
folks would disintegrate rather then blow
up. Combined with our heat crowd
dispersing technologies and other new
weapons would tell the world, fight us and
be disintegrated. We must lead through
the Big Stick concept which Barack done
conspicuously or unconsciously has
dismantled relative to our overall military
strength prior to his being elected.
If left alone, Syria
could overcome the insurgence. If this
occurs, then would be the time to impose our
will on al-Assad to go or at least make sure
the citizens are left to live free lives.
In other words we must work with the
national community to improve the Middle
East and not destabilize it any further as
we have. This editor must opine the
only thing our nation has to apologize for
is what Barack has done relative to the
outcomes in Libya and Egypt. Having
written that, Barack is a smart guy and
surely sees the mess he has made out of
things, including leaving Iraq absent a base
of operations, a toe into the region
(INTELLIGENCE GATHERING rather then being
left deaf, dumb and blind as we are)
to maintain the peace. A stratagem
which stabilized the world until the
Terrorists practiced on Russia and now focus
on the West. Why? The west is
strong because of our diversity, and weak
when the wrong side of diversity becomes in
charge of the Military. Barack's world
is much like Jimmy Carters world. They
have lead through mouth strength and not
real strength. But that seems to be
changing relative to Syria.
Israel could be the
best advisor's we have in the region.
Yet our nation has treated them poorly in my
judgment albeit Israel's patience with our
leadership will prove positive, if we begin
to act wisely rather then just being a few
smart guys. Look at our current AG.
Last week an Afro-American patient stated
that if illegal aliens from any nation are
in the same position Black folks have been
relative to civil rights, then our AG is
saying there has never been racism based on
the color of ones skin! What a mess
this administration has made out of the
simplest things in life. Why? They
have continually and continue to outsmart
themselves trying to change the names of
things they don't like into code words,
which basically breaks the Dictionaries of
our world down to useless tools. This
in turn makes society dumb down.
In any event, this
editor see's a glimmer of learned wisdom
coming from Barack on Syria
(Watch, the day after
this is published, he will go off half
cocked again and prove me wrong...as so many
times before), and perhaps we can
develop a consensus among our elected folks
once some handle on the Syrian situation
develops. For example this editor
would opine Barack call Putin, and ask Putin
who has so much vested in having a warm
water Syrian base, to place their soldiers
into Syria to bring stability there rather
then ours. Folks if we could get a
President who could develop relationships
like the Gripper did, all this terrorism
stuff could be controlled. Lets face
it if the US and Russia were best of
friends, our combined power could end
Terrorism around the globe in short order.
But the world powers under Barack are so
divided it is uncanny. China out to
steal everyone's secrets and technologies,
Russia trying to walk the fine line of
learning Capitalism the way we used to do it
combined with rebuilding its military and
financial strength while Barack dismantles
everything to create a utopian America akin
to Greece where we must disband our
military, our insurance industries, our
banking industries, and so forth which in
turn creates a third world almost wounded
America. Our Airports, roads, bridges,
plumbing an so forth is becoming third world
quality relative to many of the foreign
Airports, roads, bridges etc.
Well there we have it,
a closed description of the world as we now
find it yet our President not rushing into
Syria proves he has learned and perhaps will
find a way to work with the world community
on this one, and end the creation of
Terrorist nations around the globe as well
as inviting so many terrorists into our
nation which has caused too much turmoil for
anyone to tolerate. For example they
may say that Terrorists bombings are down
statistically in our nation, but when do you
remember having Two Terrorist Attacks both
killing Americans in the same year (Benghazi
and Boston), shootings in grade schools and
high schools, movie theaters, chemical
toxins in our mail, fired police officers
going on the rampage offing the innocent,
and truly too much more. Never folks.
And the last thing we need right know is for
us to go to war in Syria only to end up with
a terrorist nation we may have to fight
combined with Libya and Egypt. The
buck must stop with Syria, and from here on
only act intellectually, wisely and with
prophylactic protects (Internal controls) in
place, so the best outcomes emerge rather
then new problems which have been witnessed
for the last ten years or so. Patience
and wisdom must be our key and end the rush
to war or rush to judgment which has been
the legacy of these last many years .

Well the lord works in
mysterious ways. Forensic evidence
from Intelligence sources around the globe
now points to remnants of Saddam
Hussein's weapons of mass destruction
detected last week in Syria. These are
not the run of the mill toxins which are so
heinous the world would attack. No
these were Saddam's pride and joy's because
these poisons kill insidiously, which is why
many can only find remnants of blood Sarin
mixed with? In time if the press
allows freedom of information you will find
that in order to control the Al-Qaeda
terrorists and friends (Similar
Organizations) who have taken over the fight
against the dumb Syrian Government, WMD's
were used. Dumb is the correct word
for if any of the nations from Libya to
Egypt would have told the truth, that
radical Islamic jihadists had infiltrated
the honest folks who were fighting for a
government like ours prior to Barack Obama,
things would have worked out well. Our
Ambassador in Libya would be alive, there
would be a US copy government and military
in Egypt, and Syria would have found friends
it always hoped for rather then having to
rely of fly by night friends such as Iran
and world power Russia.
This editor will bet
you dollars for doughnuts that more and more
of Saddam's weapons of mass destruction will
turn up albeit this editor would prefer, the
Syrian government not fall and become
another terrorists strong hold for that
which will enslave the world like Nazi's
would have, Islamic Jihad terrorism.

you far better then Barack Obama and his
minions have. It is as clear as day to

out of style make up nonsense to attack the right.
This includes taking everything out of context to try to
create an image that doesn't exist. Mr. Oliver
wasn't even that funny.
Like Juan Williams or Ms. Holder, as soon as the bull
starts to fly, my significant other changes the channel.
Well, that meant last night some shows on both networks
were missed as well as those that followed. Thank
goodness for the NBA finals, for a wrinkle in time, that
brought this viewer back to ABC.
This editor sincerely believes that Fox should try to
pick up Jay Leno if he wants to work. Intellectual
humor often times is better then phony baloney humor.

the John Oliver's documented sources, the best host this
editor has seen in years, when the US Government is
looking at your emails, phone calls and so forth, their
computer program takes in all the data, all Americans
data, and only has a 50.1% accuracy of actually
REVIEWING FOREIGN NATIONALS OR FOREIGN TERRORISTS. Meaning
almost 50% of the time they are looking at your stuff
folks. Oliver was grand. He advised it was like
throwing a coin in the air, and adding a 1% probability
of correctly reviewing a foreigner and 49% chance of
reviewing you
("we the people").
But the point
wasn't funny. Unless we change our government, "we
the people" are in real trouble. Help me and
others

THE
RUNAWAY TRAIN
Probably the most
disastrous
case I was ever involved in was this one in
which a Train consisting of four locomotive
units, 90 cars loaded with Trona, and two
helper units at the rear, started down a
steep grade at Cajon Pass. The top of
this pass has an elevation of over 4,000
feet.
As the train started
down the grade the engineer was making
service braking applications to slow it
down. However it kept speeding up again and
he was having a lot of problems controlling
said speed. What he did not know was
that he was overloaded weight wise, and as
he was making the service applications the
wheels of the cars were getting hot and he
was burring up his brake shoes.
The locomotives have
two types of brakes. One is the
airbrake system, which goes throughout the
entire train and operates on each car of the
train. The other one is an electronic
grid brake system, which works on the
locomotive units only. This electronic grid
system is known as dynamic brakes. The
engineer still had the dynamic brakes but
when emergency air is applied it
automatically cancels out the dynamic
system. The helper engineer at the
rear of the train panicked when he saw the
speed increasing and applied the eme4rgency
brakes, thereby knocking out the dynamic
brakes and leaving the train with no braking
power whatsoever.
The train continued to
pick up speed as it went down-grade and the
crew knew they were going into a curve at
the bottom, which they could not make at the
speed they were moving. They made numerous
They made numerous May Day calls for
help and advised the railroad that their
train was moving away. The engineer was a
very decent, conscientious young man and the
conductor that was with him in the
locomotive had been a high school classmate
and life long friend. When they
reached the curve at the bottom of the grade
the train speed was approximately 110 miles
per hour and the locomotive left the track
and dropped about 30 feet onto the ground
taking all of the cars with them. The
curve was adjacent to a residential area and
a number of cars loaded with Trona smashed
into homes in the area.
The engineer survived
with numerous injuries including
psychological damage. The brakeman and
conductor were both killed. Two
children in one of the homes were also
killed and there other various injuries.
Fortunately this accident occurred at the
time of the morning when most people had
left for work. The two-helper units at
the rear of the train stayed on the tracks
and their crew was not injured.
I was assigned to
investigate
the
case and I found a seemingly mountain of
errors which led to the causation of the
accident. One of the big problems was that
the train had originated in Mojave and one
of the clerks at the rail station estimated
the weight of the load as 60 tons per car.
These cars had been filly loaded and the
weight was actually 100 tons per car.
A computer profile of the weight of the
train and consist was given to the engineer
and from this he calculated the tonnage per
operative brake. Because the weight
was wrong, all the computations were wrong.
Also one of the four locomotive units had no
dynamic brakes. The engineer knew of
this and tried to compensate but he did not
know that one of the helper units at the
rear of the train also had no dynamic
breaks.
The engineer was
operating the train under the rules for
mountainous grades in a proper manner for
the weight he thought he had, which was
grossly underestimated. As he kept making
service applications to slow the train down
he burned up most of the brake shoes and
ultimately had no train braking system.
The railroad responded
and set up temporary housing for the people
whose homes has been destroyed and other
that had been evacuated. They also provided
food and medical attention for these people.
I did not take part in this since I was
investigating the case and had to go to
Mojave, Bakersfield and other places. The
representatives of the National
Transportation Safety Board (NTSB)
arrived from Washington D.C. and began their
investigations. I met several of these
folks and coordinated my investigation with
them. After a few days the people
whose homes were not destroyed were allowed
to go back
.
My investigation was winding down and I
returned to my office.
I later learned that
many of these people who had been evacuated
were conducting business as usual from the
hotel rooms. Various dealings in crack
cocaine and other street drugs were
continuing to take place. A
transvestite prostitute was picking up male
clients in the bar and taking them to
his/her hotel room. When I leaned of
this I had the person evicted from the
hotel.
There was also one
lady who had quite a history with the San
Bernardino police. When the claims agents
were giving advance checks to the
neighborhood
people to help with their
expenses, she received $2,000 which one of
the claims agents had taken to the motel
office and gotten cashed for her. She later
found out that one of the neighbors who had
more children received a larger advance and
this sent her into a rage. She charged at
the door of the claims agent at the hotel
and threw the money in her face. Fortunately
the claim agent was able to slam the door
and lock it leaving her in the hall. This
lady also had to be evicted from the hotel.
After the
investigation of the accident quieted down,
I spent one day going through the people who
were staying at the hotel and eating meals
provided by the railroad and learned of a
number of fraudulent claimants. One
mother who lived 15 miles away from the
scene of the accident and had sustained no
damage whatsoever was continuing to feed
herself and her five children. Another
lady and her husband who lived in the
neighborhood about two years, whose house
had burned down prior to the accident were
staying in the hotel and received advances
and food and lodging. These cases were
quickly disposed of by eviction. Many
of the people were taking full advantage of
benefits that did not belong to them.
About ten days later I
received word that a pipeline had blown up
in this same area and the neighborhood was
in flames
.
I immediately returned to the scene and
found all of this to be true. A CalNev
pipeline ran between San Bernardino and Los
Vegas, Nevada in which gasoline was
transported and it had exploded. The line
was directly underneath the area where the
train had derailed.
After the derailment
the pipeline had shut down for a day or two
but had returned to operation. CalNev had
failed to properly inspect the pipeline.
All they did was to drill four boreholes
down to the pipeline, which was about ten
feet under the surface, and observe it.
They could have run water
under pressure to see if there were any
leaks but did not do so. Also they
could have sent a blind pig through the line
(this is a device which is equipped with
feelers on its legs and if any fractures
were present it would show them on the
electronic graph it made).
They did not do this.
The worst failure was
that one of the pump station operatives was
present when the automatic safety feature of
the pipeline worked and it shut down
operations. He overrode this and
allowed the gas pump through. The problem
for the railroad was that any damage to the
line would have been cause by the derailment
or cleanup. Again temporary housing,
hotels and food were provided for this
decimated neighborhood. I went to work
with the NTSB people and completed another
investigation.
One of the plaintiffs
attorneys that I have known for many years,
and whose wife had been with the Red Cross
showed
up at the scene and started signing up many
of the neighborhood people. He was
also staying at the Hilton hotel which is
where we were staying. He contacted me
and asked if we could have a meeting at his
hotel suite and if I would bring the
attorneys from both the railroad and CalNev.
He stated he would have several of the
neighborhood leaders present and there were
several problems they wanted to discuss.
I agreed to attend the
meeting and took the attorneys with me.
When we walked in the door he handed us a
restraining order to shut down the railroad
that had been signed by a judge in San
Bernardino Court. He also gave the same
restraining order to pipeline attorneys.
Their pipeline was shut down anyway since
they had not yet determined the causation of
the explosion. We advised the general
attorney for the railroad of this
restraining order and he went to management
and the railroad was shut down for three
days.
We later contacted the
judge that had supposedly signed the
restraining order and he advised this was
the first time he had ever heard of it. It
was obvious that this was a forged order and
we immediately started railroad operations
again and brought charges against the
plaintiff attorney. He was fined by the
state bar and we also filed a suit against
him. In response to this lawsuit he
filed a cross complaint with the railroad
and alleged that he had become violently ill
from exposure the load of trona which was
the train cargo.
Several years later I
had to go to San Bernardino to a settlement
conference and this attorney was in
attendance. The judge asked me if I would
pay any money in the exposure case and I
told him absolutely not. By this time the
attorney had also filed bankruptcy and he
could not pay for shutting down the railroad
for three days, which was very costly to the
tune of about $300,000.
He confronted me in
the hall and wanted to know why I would not
pay anything on his exposure case and I told
him that I was not in the habit of paying
for fraudulently manipulated cases. I
explain to him that trona was a naturally
occurring substance in the earth and no one
suffered any ill effects from exposure to
it. Further that I had been born and
raised in Natrona County, Wyoming were there
is an abundance of trona in the ground and
it is carried about by winds etc and none of
the inhabitants had ever suffered any ill
effects from it. Also that if he truly
did become ill due to exposure of trona, no
one forced him to walk around in it signing
up clients.
This attorney was
later charged with fraudulent theft from his
clients
(see copies of
newspaper articles from the Loss Angeles
Daily Journal at the end of this case write
up). As a result, most of his
clients from this tragic accident did not
ever receive any monetary damages.
I was present when the
damaged section of pipeline was removed from
the ground. A fish mouth fracture was
obvious in the side of the pipe and this had
to be either caused by the derailment
or metal parts from the train, which came in
contact with it during clean up. The
gasoline under pressure going throughout the
pipeline reached the fracture and then a
spray went up into the air about 300 feet
forming a vapor cloud. The prevailing wind
carried this cloud into the houses, and
something, probably a pilot light in a
stove, caused the gasoline to
explode and turn into a fire ball.
Because of the
pipeline responsibility in the explosion,
they agreed to handle is of the claims,
which resulted. Even with this agreement, a
temporary claims office had been opened up
in San Bernardino and it remained open for
about one year. This office was shared with
the pipelines.
Unfortunately most of
the people who suffered damage from the
pipeline explosion did not get their money
as their attorney declared bankruptcy and
was forced to withdraw his membership from
the State Bar.
The railroad had
settled all of the claims from the
derailment including the deaths of two
employees. The engineer settled but remains
to this day permanently psychiatrically
limited in train operations as he can no
longer work on the mountain and is
restricted to the Bakersfield Yard and train
runs to Fresno and back which are on flat
terrain.

SUPERPOWER USA ADDED JUST 88,000 JOBS IN
MARCH
It is almost surreal
that a nation our size only added 88
thousand jobs in March. Further the
Bureau of Labor Statistics estimated that a
half a million fewer people then the last
report of 1/2 million fewer folks were
participating in our labor force giving the
false impression that the unemployment
numbers dropped 1 percent to 7.6 %.
This editor never
thought that in my lifetime we would see
such phony numbers used to tell us about the
health of our nation. Lets review:

LIFE CHIROPRACTIC COLLEGE WEST
Your editor never
attended Life however believe it or not (I have the letter), after
your editor published the first textbook sound scientific mechanism for
what the heck Doctor's of Chiropractic treat with manual medicine, I received a
letter from the Journal of the American Chiropractic Association asking my opinion on a
letter written by the Life College folks asking permission to teach my ideas
and concepts at their college; so there would be no violation of
copyright. Your editor was so honored of
course I through my hat in, and then your editor received the letter
acknowledging this by the ACA.
Many years later after having attended and help to
build the pre-American Back Society giving Workers Compensation and
advanced state of the art understandings of human biomechanics in
lecture format, and
after become a Founding Fellow of the American Back Society, I was asked
to put on a lecture at the second meeting. However several hundred
requests came in for the Life College President and your editor then
requested a Chiropractic College President be allowed to lecture with
the famous Medical Physicians. However at the very last minute,
the National Medical Accreditation folks who were granting California
Medical Doctors continuing medical education credits advised, they had
granted this with the understanding that my then groundbreaking
(One of the First in the Nation to discuss the
issues as human biomechanics, yes first to show the evolution of the
spine and the plantegrade posture vs. gravity, advanced Neurology which
fostered the Neurology programs within my profession as one fellow
actually came up to me and asked if he could use my stuff, and by
George, he became one of the top guys to this very day in that field of
teaching and granted accredited Diploma's) epiphanies in the
human biomechanics', physiology, neurology, spinal stabilization
exercise rehabilitation and manual medicine arenas were to be
presented. Literally on my way to Florida with a
Lady Friend, I received the call for help, and
dropped everything, went to my home in Palos Verdes California, dug up my slides and we flew to San Francisco
(St. Francis Hotel) to be the first DC to lecture to MD's for their yearly continuing
medical education credits within the United States

the weight of the load as 60 tons per car.

train and consist was given to the engineer
and from this he calculated the tonnage per
operative brake. Because the weight
was wrong, all the computations were wrong.
Also one of the four locomotive units had no
dynamic brakes. The engineer knew of
this and tried to compensate but he did not
know that one of the helper units at the
rear of the train also had no dynamic
breaks.
