stop the scourge of the 21st century-Cancer.
The United States Food and Drug Adminstration announced on April 14, 1998 three
contracts with American states to protect children from Tobacco. Surprise, there was
$36 million in this years budget to assist states in enforcing the regulation and to
educate all citizens, retailers and the general public.
Initially, the first provision of FDA's final rule to protect children from tobacco
took effect February 28, 1997. The age of 18 is the minimum to purchase tobacco
products and requiring retailers to check photo IDs of anyone under age 27.
The aforementioned is only a part of the comprehensive program designed to reduce by
50% the number of young people who smoke in the next seven years.
The Historic April 25, 1997 ruling by the Federal District Court in Greenboro, N.C.
gave the FDA jurisdiction under the Food, Drug and Cosmetic Act to regulate
nicotine-containing cigarettes and smokeless tobacco. All restrictions relative to
youth pertain to access and labeling, including the two provisions that went into effect
February 28
. The case is currently under appeal.
The Surgeon General reviewed 13 studies relative to ease of access to tobacco product
where minors were able to score 67% success rate of purchase. 3,000 children and
adolescents become regular smokers, and nearly 1,000 will die prematurely from a
smoking-related disease.
Thus, each state, must in its own way, demonstrate a prudent prophylactic action
necessary to protect the greatest citizen nation in mankind's experiential
existence.

With just these three states 17,900 unannounced retail compliance checks over the next
12 months are ensured. The criterion will be typical dress, accompanied by an adult
and attempt to purchase cigarettes or spit tobacco in retail stores. FDA will issue
a warning for the first violation to retailers found selling to adolescents. These
retailers will be subject to repeat inspection. FDA will seek a fine of $250
for the second violation and greater fines for subsequent violations.
Medical facts demonstrate that associated with tobacco consumption are increased
pulmonary tension (disability associated with respiratory activities which elicit a
handicap) in later years, the greater the ability to develop new aviolar respiratory
centers in the lung upon exercise. The less damage to the lungs themselves, the
easier the reconditioning for cardiovascular fitness and activities.
All States should participate through appropriate processes to reduce the burden of
regulation, harmonize regulatory requirements, and achieve appropriate reciprocal
arrangements where the Constitution can once again begin to function with equal
liberty and justice affirmation once again.
This examiner urges additional states to join in the fight to allow our children to be
our healthy future and their children's healthy future. This is only a safety check,
for our children are our future.
