BENEATH THE DIGNITY OF MANKIND-RAPE & THE INVESTIGATION 2

      The forensic laboratory examination leads to not only the general identification characteristics of a suspect but his actual DNA.  This is unique to him.  However if the testifying forensic person cannot stand the test of courtroom Examination or cross-examination as we see in case after case than all is lost.  I can personally assure you that I have been retained on many death cases, paraplegic cases and so forth, had the criminals on the ropes ready for the final count down, when cocky persons with money who then want the glory to shine on them have destroyed the case.  This occurs by putting on the stand ineffectual so called experts who have the fluidity of a rock.  Yet when this examiner was allowed to testify as the Expert for the Grand Jury on the Largest Insurance Fraud Case in the History of the United States, my U S Attorney was able to get his indictments.  On the largest Medical Device Fraud case in the history of the United States and on and on the criminals were brought to Justice.  However, beware of experts, they are everywhere and will undercut the actual costs of a quality Forensic Examination as the Green Poultice makes good men criminals.  What this examiner is saying is never claim you can do what you cannot, never undercut an expert who developed forensic evidence to the nth degree where obvious verdict is at hand.  The verdict can never be predicted.  Too many so called experts in our nation ruin cases after cases as they simply due not have the basic I.Q., and common sense to handle the test of Judicial Review where incredibly intelligent attorneys who represent qualified wrongdoers will destroy all the good forensic work that preceded you.  Please, tell the truth and let the forensic expert who developed this alleged perfect product for trial, be the expert who testifies.  My personal experience at being a humble human being is that there is always someone who wants the glory and the gold.  However, only the best simply want Justice for the Victim and then expect their due compensation when the trial is over.

THE FORENSIC MEDICAL EXAMINATION

      The medical examination is not only one of the most crucial aspects of the case, but is often blown by using physicians with no qualifications as Forensic Examiners.  One case that this examiner occurred by two Wiley police officers who would rape the female in the back of the car, book them in as disorderly behavior, rape them again on the way to the local hospital and make sure the physician was of poor quality.  It took ten years, to expose the crime, several arrests were made, but my initial Audit of the case was ten years prior to any attention being brought on the unusual perpetrators of that particular inhuman rape.  Remember that a person in high authority who is looked up gains a psychological advantage the women are not even aware of.  Example are a doctor, lawyer, Police officer, President and so forth, often would have women overcome with being in the Doctor’s examination room, Police car enjoying a ride, or just a loss of personal character perhaps sitting in the Oval Office.  Never abuse your position as a Certified Forensic Fraud Examiner, Agent, Investigator or Detective.  Believe in the Constitution, and follow its simple tenants, and help stop others from stooping beneath the dignity of mankind.   

     On a rape case only have a qualified forensic medical physician perform the examination.  Treatment will be needed for therapeutic and prophylactic reasons as the memories or damage to the “carnal being of the female” may either never go away or pass in time too slowly for her to become a quality citizen again.   Further a sophisticated Forensic physician’s findings will establish proof that penetration and, therefore, rape occurred.  The victim has every right to be examined by a physician of her choice.  For the reasons above this should be discouraged unless you can provide a list of such quality Forensic practitioners.  Certifications such as a Life member of the American College of Forensic Examiners and in the best case scenario, one who is not only a Certified Forensic Examiner but also a Certified Fraud Examiner would be ideal.  This combination insures a true understanding of all ramifications of not only law but also medicine and justice.  Further experience has demonstrated that a hospital staff physician is generally reluctant to be specific in officially reporting his findings or to take time off from his schedule to testify in court. 

     Compassionate yet strong persuasion and tact will influence an unwilling victim or her parents to allow a physician from a public institution to conduct the examination.  However, when you explain the physician you are referring to is a Certified Forensic Medical Fraud Examiner, then either the victim or the parents will want the best credentialed physician who’s thorough discoveries and subsequent testimony will stand the test of Judicial Review. 

     The forensic medical examination will establish proof of penetration and other medical findings indicating the violence, which may have occurred.  This medical examination usually consists of a visual examination of the vaginal area to identify tissue damage, lacerations, abrasions, contusions or other indications of physical trauma.  Smears are also obtained from the vaginal passage to determine the presence or absence of sperm.  Remember that the presence of sperm merely corroborates that the victim had sexual intercourse, not necessarily that she had been raped.  Again the reason for an experienced licensed medical physician who is a certified forensic fraud examiner.  This examiner will have much experience with Rape Victims and make the proper documentation of criteria, which establishes a rape occurred. 

     After the examination obtain a written statement or report from the forensic physician after the victim has been examined.  This report is extremely valuable at the trial to sustain the victim'’ allegation that she had been raped.” 

     Sadly, in some case the victim dies before the medical examination.  If this occurs the coroner must examine the body.  No one is to tough the body, no doctor, no acupuncturist, no one but the forensic pathologist.  Never allow an alleged examination to destroy or remove important evidence.  The forensic medical examination of the expired victim should include other body cavities such as the anus, the mouth, ears, crotch, knees and so forth.  Scraping must also be taken from under the fingernails.  The thoroughness of the examination is necessary to determine the kind of sexual assault suffered by the victim, the type of instrument or weapon used by the assailant and to obtain specimens of blood or DNA that could be the assailant’s.  Oftentimes the criminal insets foreign objects into the body openings that cause death to prevent testimony such as a rectal suppository of opiates and so forth.  Just as in Murder 1-6, the forensic medical examiner is to be given all the known circumstances surrounding the death of the victim. 

INTERVIEW HOW’S, WHY’S AND OPERATIONS 

     The court must be provided with a thorough audit of the offense describing the actions of the offender, his accomplices and all criteria involving the victim.  It is the Agents or investigator’s responsibility to provide the court with the explanations and clarifications it needs.  The physical evidence will provide a portion of the story.  However an eyewitness account of the victim or other persons who can fill in the missing pixels of the picture presented to the court will insure the court receives what it seeks. 

     As stated previously, be informal and natural yet strong in order to allow the victim to relax.  Chose your words consistent with the victim’s age, intelligence, and social status or class.  Slang or colloquialism may be appropriate in alluding to matters indirectly related to the offense, but personally, it is this examiners opinion that slang uttered by the victim should be gently rephrased to simply conclusion.  Keep it simple.   

     Always use medical terms when referring to various part of the human body such as vulvas or penis for example.   You may have to define terms for the victim before the interview.  This will add dignity to the confidential nature of this professional relationship that needs to be established.  Formal terminology indicates a respect for the private parts of the body and serves to allay any doubt or misgiving of your sincerity and interest at bringing the criminal to justice.  Remember that if you are embarrassed or fee uncomfortable or anxious the victim will sense your insecurity and may become more inhibited or restrained.  You must focus and control your sentiments, remain emotionally detached yet not callous or indifferent to the victim.   It is wise to have another Agent with you during the interview.  This is a safeguard as an excited victim could easily misunderstand your intent, and just as I stated in the opening, misinterpret your standing on a pedestal and either become attached to you unconsciously, or even complain about your conduct.  A female Agent makes the best witness to the interview.  If this is not possible a nurse by virtue of her position and training makes her an excellent disinterested third party.  If your interview site were a hospital or other medical facility, an impartial and profession female nurse would be readily available.  Further, once recovering in a medical facility or hospital, the physical surroundings will provide the desired privacy and the hospital and what it symbolizes restores confidence in the poor victim. 

    The Rape Audit or Report must have significant clarifications demanded by the court, which are different from the reports, audits, narratives or statements you have learned thus far.  In the next section Beneath the Dignity of Mankind-The Investigation of Rape Part 3 will detail exactly what you will need to make your report stand the test of Judicial Review.  You will also study aspects of false complaints, how to handle the situation and determine the actual respective details of the crime.   You are dealing with a victim whose life will never be the same.  Do not be callous.  It could be your mother or daughter or friend.  You will never know when this heinous criminal will strike again.
